# Liquor liability insurance in Illinois

Illinois’s Dramshop Act allows an in-state claimant injured by an intoxicated person to sue a licensed seller that caused the intoxication. A separate retail-license eligibility provision requires liquor-liability coverage for premises where alcohol is sold for use or consumption, at least equal to § 6-21(a)’s maximum liability amounts. For judgments or settlements on or after January 20, 2026, the Commission lists CPI-adjusted ceilings; those legal amounts do not establish policy terms or claim coverage.[^1][^4][^2]

## What to Watch for in Illinois

### Statutory claimant route

Section 6-21(a) creates a statutory action for a person injured in Illinois by an intoxicated person against a person licensed to sell alcohol who caused that intoxication. Confirm whether the named business is the seller, a caterer, a host, or another role before mapping the claim to a policy.[^1]

### 2026 recovery limits are not policy limits

For final judgments or settlements awarded from January 20, 2026, the Commission lists caps of $90,411.55 per person for injury/property damage and $110,503 for loss of support or society. Section 6-18(18) uses the § 6-21(a) maximums as the premises-insurance floor for the covered retail license applicant; the figures still do not establish what any policy covers or how its limits apply.[^2][^1]

### Special premises can add insurance conditions

Section 6-15 contains specific state-controlled-premises authorizations conditioned on dramshop insurance. That narrow text should not be generalized into a statewide mandate for every private bar or restaurant. Check the particular license, public-property arrangement and local approval.[^3]

### Review the annual adjustment

The Illinois Liquor Control Commission says § 6-21 limits are recalculated annually using CPI-U. Ask for the current effective caps when evaluating a claim or renewal; compare those legal numbers separately with occurrence, aggregate and defense-cost terms.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.5% of taxable premium plus a 0.04% stamping fee; separate 1% fire marshal tax on taxable fire premium When Illinois is the insured’s home state, the broker reports and remits a 3.5% tax on gross taxable surplus-line premium less returned taxable premium. **Illinois guaranty fund limits:** For covered claims against a member insurer, the Illinois Insurance Guaranty Fund generally caps its obligation at $500,000 per claim; workers’ compensation claims are excepted from that dollar cap. This fund does not protect policies issued by nonadmitted surplus-lines insurers. The net-worth exclusions apply to covered claims against member insurers.[^10]
