# Liquor liability insurance in Georgia

## What to Watch for in Georgia

### Driving-related statutory exception

For an adult, a claim against an alcohol provider requires knowingly serving someone noticeably intoxicated while knowing the person will soon drive; the statute also addresses unlawful service to a minor known to be soon driving. The 2024 court held visible keys and a car outside could support a jury question about knowledge.[^1][^2]

### Consumer injury limit

O.C.G.A. § 51-1-40(b) does not authorize the alcohol consumer to recover for the consumer’s own injuries. Ask how the policy responds to claims by other injured people and whether defense costs reduce limits.[^1]

### Premises immunity is a separate rule

Section 51-1-40(d) limits an owner, lessee or lawful occupant’s liability when alcohol is consumed on the premises without that person’s consent; it expressly excludes premises licensed for alcohol sales from that immunity. Confirm who supplied alcohol and who controlled the property before asking how a venue or host policy applies.[^4]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of total premium when Georgia is the home state Georgia charges 4% on the total premium written and received by a surplus-lines broker when Georgia is the insured’s home state. ### Can the person who drank recover under Georgia’s statute?
