# Liquor Liability in Florida

Florida Statutes §768.125 generally prevents liability for selling or furnishing alcohol to a person of lawful drinking age, but allows liability for willful and unlawful service to someone underage or knowing service to a person habitually addicted to alcohol. Section 562.11 separately prohibits sales to people under 21 and provides a careful-ID defense.[^1][^2]

## What to Watch for in Florida

### The general rule has two statutory exceptions

A provider may become liable for injury resulting from intoxication when it willfully and unlawfully supplies alcohol to someone under lawful drinking age or knowingly serves someone habitually addicted to alcohol.[^1]

### The underage-sale defense has several conditions

Section 562.11’s defense requires a false age representation, an appearance that would persuade an ordinarily prudent person, careful inspection of an approved ID, and good-faith reliance; checking a card alone is not the full statutory test.[^2]

### The civil statute is not a coverage specification

Sections 768.125 and 562.11 describe liability and underage-sale defenses; they do not state what limits, defense terms, exclusions, or insured entities an individual policy must provide.[^1][^2]
