# Last-mile delivery insurance in Wyoming

W.S. 31-20-107 requires $50,000 per person, $100,000 per incident, and $25,000 property damage while a driver is available for prearranged rides but not on one, and $1 million while engaged in a prearranged ride. If the driver's policy lapses, the company's insurance must cover the claim from the first dollar and defend it. W.S. 31-20-108 allows an insurer to exclude any coverage while the driver is available or on a ride, and it preserves an existing exclusion for vehicles used to carry persons or property for a charge or available for hire by the public.[^1][^2]

## What to Watch for in Wyoming

### The Exclusion Can Reach Collision and Medical Payments

W.S. 31-20-108 lets an insurer exclude any coverage while the driver is available for a request or engaged in a prearranged ride, including liability, uninsured and underinsured motorist, medical payments, comprehensive, and collision. Nothing in the section requires the personal policy to cover those periods. If it excludes them, the company policy required by 31-20-107 has to respond.[^1]

### An Older Charge-or-Hire Exclusion Still Counts

The same section says the chapter does not invalidate an exclusion already in a Wyoming policy for vehicles used to carry persons or property for a charge, or available for hire by the public. A delivery of property for a charge can fall under that preserved exclusion even when the trip is not a passenger ride. Read the personal policy for that wording.[^1]

### The Company Does Not Wait for a Denial

Coverage under the company's policy shall not depend on a personal insurer first denying the claim. If the driver's insurance lapses or is short, the company insurance provides the required coverage from the first dollar and its insurer defends. The current Title 31 compilation still states the $50,000/$100,000/$25,000 and $1 million limits for rider transportation.[^1][^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of premium The NAIC's state chart lists a 3% of premium charge for surplus-lines coverage for Wyoming (the chart's state entries were reviewed in October 2025).
