# Last-mile delivery insurance in South Carolina

Article 16 of Title 58, Chapter 23, requires primary automobile liability of at least $50,000 per person, $100,000 per incident, and $50,000 property damage while a driver is logged on and not on a prearranged ride, and at least $1 million on a prearranged ride. The article covers transporting riders. The Department of Insurance's July 2014 ride-share alert says most standard personal auto policies exclude livery, generally meaning driving for hire, and it quotes an exclusion for liability arising out of carrying persons for a fee.[^1][^2]

## What to Watch for in South Carolina

### Logged-On Property Damage Is $50,000

Section 58-23-1630 sets property damage at $50,000 in the logged-on period, not $25,000. A quote that copies another state's $25,000 property figure is short before the ride starts. The $1 million limit is the prearranged ride, for death, bodily injury, and property damage.[^1]

### The Department Quotes a Fee Exclusion

The July 2014 alert says most standard personal auto policies exclude livery, which it describes as driving for hire, and it quotes exclusion language for carrying persons for a fee. That exclusion can apply to the logged-on period, when the driver is available to transport riders. Read it before you assume the personal policy is the $50,000/$100,000/$50,000 layer.[^2]

### The Coverage Recognizes Transporting Riders

The statute requires coverage that recognizes the driver uses a personal vehicle to transport riders for compensation. A goods delivery is not that rider trip. The Department's quoted exclusion is also about carrying persons for a fee, not about the cargo itself.[^1]
