# Last-mile delivery insurance in Illinois

The Transportation Network Providers Act, 625 ILCS 57/10, requires $50,000 per person, $100,000 per incident, and $25,000 property damage from log-on until the driver accepts a request to transport a passenger, and again after the ride ends. From acceptance until the ride or transaction is complete, the primary limit is $1 million, plus $50,000 uninsured and underinsured motorist coverage while a passenger is in the vehicle. The section is scheduled to be repealed on September 1, 2028. The Department of Insurance says most personal auto policies exclude livery or driving for compensation.[^1][^3]

## What Is Last-Mile Delivery?

Last-mile delivery insurance is not one standard policy: vehicle liability, vehicle damage and cargo protection can be separate. ## What to Watch for in Illinois

### The Company Owes Contingent Coverage

If the driver's policy excludes the use or misses the logged-on limits, 625 ILCS 57/10 requires the transportation network company to maintain contingent coverage in the $50,000/$100,000/$25,000 amounts. Ask which policy is primary at log-on and which one answers if the personal policy excludes livery.[^1]

### The Section Is Set to Repeal in 2028

The statute page schedules repeal of the section on September 1, 2028. A multi-year policy that assumes today's split still governs after that date needs a fresh look at whatever replaces it. Until then, the acceptance trigger, not a generic 'on trip' label, is what moves the limit to $1 million.[^1]

### Most Personal Policies Exclude Livery

The Department of Insurance ride-sharing page says most personal auto policies contain exclusions when the vehicle is used for livery or driving for compensation. A delivery or passenger shift can fall outside the personal policy even before a passenger is in the car. Read the exclusion against the log-on period, not only against the completed ride.[^3]

### The Trigger Is a Passenger Request

Section 57/5 and the insurance duty are built around a request to transport a passenger. Accepting a goods-delivery request is not the acceptance the $1 million sentence describes. Do not use the passenger act as a parcel minimum.[^2][^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.5% of taxable premium plus a 0.04% stamping fee; separate 1% fire marshal tax on taxable fire premium When Illinois is the insured’s home state, the broker reports and remits a 3.5% tax on gross taxable surplus-line premium less returned taxable premium. **Illinois guaranty fund limits:** For covered claims against a member insurer, the Illinois Insurance Guaranty Fund generally caps its obligation at $500,000 per claim; workers’ compensation claims are excepted from that dollar cap. This fund does not protect policies issued by nonadmitted surplus-lines insurers. The net-worth exclusions apply to covered claims against member insurers.[^9]
