# Last-mile delivery insurance in Florida

As of September 28, 2026, §627.7415’s then-operative schedule sets $50,000/$100,000/$300,000 combined liability bands for commercial motor vehicles at 26,000/35,000/44,000 pounds. Chapter 2026-39, §46, takes effect October 1, 2026, and extends the amended section to qualified motor vehicles defined in §§207.002 and 320.01. FDOT separately excludes city pickup-and-delivery vehicles from IRP apportionment. These are vehicle/registration distinctions, not proof of cargo or delivery-use coverage.[^1][^2]

## What Is Last-Mile Delivery?

Last-mile delivery insurance is not one standard policy: vehicle liability, vehicle damage and cargo protection can be separate. ## What to Watch for in Florida

### Don't apply the heavy schedule to every van

The 2025 statute’s listed commercial-vehicle bands begin at 26,000 pounds; from October 1, 2026 the enacted amendment also includes qualified motor vehicles. A lighter vehicle outside one statutory band is not thereby free from every legal duty, nor does personal insurance necessarily accept delivery.[^1][^3]

### IRP treatment is not insurance treatment

FDOT excludes city pickup-and-delivery vehicles from IRP apportionment. That is a registration distinction, not a waiver of auto liability or cargo protection.[^2][^1]

### Registration and auto liability do not value packages

IRP route treatment is a registration question; it does not set cargo value or transit protection. Quote the highest load, custody period, loading/unloading and handoff separately.[^2][^3]

## Who Regulates Insurance in Florida

**Florida Office of Insurance Regulation.** The Florida Office of Insurance Regulation licenses and regulates insurance companies and reviews rates and forms. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.94% of gross premium plus a 0.03% FSLSO service fee for policies effective July 1, 2026 or later When Florida is the insured’s home state, Florida taxes the entire gross premium at 4.94%; the premium definition includes policy and similar insurance charges. The separate FSLSO service fee is 0.03% for policies effective July 1, 2026 or later. Surplus-lines policies do not receive Florida Insurance Guaranty Association protection.[^7][^8][^9]

### Does Florida's $50,000 band apply to a 10,000-pound delivery van?

The 2025 version of §627.7415 lists bands beginning at 26,000 pounds for commercial motor vehicles. Chapter 2026-39 §46 becomes effective October 1, 2026 and changes covered classes; neither schedule determines all legal duties or whether a personal policy accepts delivery.[^1][^3]

### Does the city pickup-and-delivery IRP exception exempt insurance?

No. FDOT's page concerns apportioned registration under IRP. It does not waive liability requirements or insure packages.[^2][^1]
