# Last-mile delivery insurance in Delaware

Delaware adopts federal motor-carrier safety parts, including Part 387, but excepts intrastate vehicles/combinations at 26,000 pounds or less unless they transport placarded hazmat or 16+ passengers. A separate Delaware statute describes insurer certificates that identify covered vehicles. The safety exception is not a general insurance waiver.[^1][^2]

## What Is Last-Mile Delivery?

Last-mile delivery insurance is not one standard policy: vehicle liability, vehicle damage and cargo protection can be separate. Delaware's financial-responsibility certificate must describe or reference covered vehicles when filing applies. Reconcile owned units, rentals and employee cars with filings and policy schedules.[^2]

### Safety-rule adoption does not set cargo value

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium, less return premium, when Delaware is the home state When Delaware is the insured’s home state, its 3% surplus-lines premium tax applies to the entire premium of a multistate policy, less returned premiums and excluding federal and state taxes and examination fees. Ask the surplus-lines broker to confirm the home-state determination and tax calculation, and separately explain how exposures are allocated in the required reports; those allocations do not reduce the premium subject to Delaware’s tax.[^6][^7]

Section 4702 excludes a defined intrastate class from that safety chapter subject to exceptions. Separate financial-responsibility rules still apply where relevant; neither statute decides policy coverage for a particular delivery.[^1][^2]

### Can the carrier use one certificate without vehicle identification?

Section 2948 says a certificate must identify the vehicles covered where the filing applies. Ask the broker to reconcile actual fleet, hired/nonowned autos and insurer filings.[^2]
