# Last-mile delivery insurance in Arkansas

Arkansas’s current official Code of Arkansas Rules requires public-liability/property-damage filing for motor carriers and separately requires common carriers of property by motor vehicle to file at least $5,000 cargo coverage. That common-carrier condition makes the actual service relationship important: confirm the classification with the state before treating the cargo filing as applicable. The statutory filing is not a valuation of each package.[^1][^2]

## What Is Last-Mile Delivery?

Last-mile delivery insurance is not one standard policy: vehicle liability, vehicle damage and cargo protection can be separate. If your staff deliver orders in company, rented or personal vehicles, check each vehicle, cargo and worker-injury exposure in the quote. [Read the national Last-mile delivery guide](/coverage/last-mile-delivery).

## Arkansas Requirements

| Requirement | Details |
| --- | --- |
| Property-carrier liability filing | The Arkansas motor-carrier rule lists $50,000/$100,000/$30,000 liability/property-damage minimums on each vehicle transporting property; its $5,000 cargo filing is limited to common carriers.[^1] |
| Common-carrier cargo filing | 27 CAR § 110-1301(c) separately requires common carriers of property by motor vehicle to file at least $5,000 cargo insurance.[^1] |

## What to Watch for in Arkansas

### Common and contract carriage differ

Arkansas law says motor-carrier safety tools and practices do not change a property driver’s worker status, but it does not classify a particular driver. Document who employs or contracts with each driver and which vehicles are used.[^2][^1]

### Authority and proof must match

The rule calls for liability proof for carriers by motor vehicle and states property-carrier minimums per vehicle. Reconcile legal operating entity, vehicle list and filing before dispatch.[^1][^1]

### Minimum filing is not load valuation

The $5,000 cargo number is a filing floor for common carriers, not a valuation of any package or proof that loading, theft, unattended stops or handoff are covered. Compare peak vehicle loads, custody period and deductible.[^1]

## Who Regulates Insurance in Arkansas

**Arkansas Insurance Department.** The Arkansas Insurance Department licenses resident and nonresident producers and business entities, accepts insurance complaints, and provides links to company and producer license searches. It operates as a division of the Arkansas Department of Commerce.[^3][^4][^8][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% when Arkansas is the insured's home state Arkansas's broker filing instructions set a 4% surplus-lines tax. Federal law assigns nonadmitted-insurance regulation and tax to the insured’s home state; for a multistate policy, ask your broker to show the home state and the premium allocation used for the Arkansas filing. Arkansas law requires the contract to disclose that the state's property-and-casualty guaranty protection does not apply.[^6][^7][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://insurance.arkansas.gov/industry-regulation/licensing/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Arkansas

1. Is the operation common carriage, contract carriage or private own-account delivery, and what exception might apply?
2. Does the insurer's proof meet the ARDOT filing and name?
3. What is the highest single-vehicle shipment and covered transit period?
4. Which employee, leased, rental and personal autos can be used?

## Last-Mile Delivery in Arkansas: FAQ

### Does every Arkansas courier need the $5,000 cargo filing?

No. The rule states the $5,000 cargo minimum for common carriers of property. The rule excerpt does not resolve how a particular delivery arrangement is classified, so confirm that status before treating the filing as applicable.[^1][^1]

### Does the liability endorsement pay for damaged packages?

No. Arkansas lists property-transport liability/property-damage amounts separately from common-carrier cargo filing. Quote cargo against shipment values and custody period.[^1]
