# Kidnap and Ransom Insurance in Maine

Current §2002-A permits a federal exempt commercial purchaser to place surplus lines without §2004’s search procedure only after the producer discloses that admitted insurance may offer greater protection and regulatory oversight, then receives the purchaser’s later written request. Current §2009 requires a separate 16-point application notice, a signed and dated acknowledgment, five-year retention after policy expiration, and a copy attached to each delivered policy. The prescribed notice says surplus-lines insurers do not participate in guaranty funds; check the notice delivered with the K&R wording.[^2]

### Maine Rules Apply When Maine Is the Home State

Section 2001-A limits Maine’s surplus-lines chapter to transactions where Maine is the applicant’s or insured’s home state, subject to its stated exception. A Maine employee’s travel or incident location alone does not establish which state’s placement process governs.[^3]
