# Kidnap and Ransom Insurance in Louisiana

Louisiana allows surplus-lines placement through a licensed broker without regard to whether authorized insurers offer the coverage. ## What to Watch for in Louisiana

### No Admitted-Market Search Is Required

R.S. 22:432 permits surplus-lines procurement without regard to whether authorized insurers offer the coverage, but only through a licensed surplus-lines broker. Compare any admitted and surplus-lines K&R wording on the named people, extortion triggers, travel territory, and response costs; the placement rule does not decide what the contract covers.[^1]

### Check the Signed Louisiana Notice

R.S. 22:433 requires a notice on each surplus-lines contract saying it is delivered under the Louisiana Insurance Code and that the two Louisiana guaranty associations do not cover it if the insurer becomes insolvent. The notice must be red or black-bordered, bold at least 10-point type, and signed by the placing surplus-lines broker; check the issued K&R policy itself.[^2]

### The Separate Acknowledgment Is for Personal Lines

R.S. 22:438’s separate applicant acknowledgment applies to personal-lines policies. For a business K&R placement, ask for the §433 contract notice and the broker’s license details rather than assuming the personal-lines acknowledgment applies.[^3]

## Who Regulates Insurance in Louisiana

**Louisiana Department of Insurance.** The Louisiana Department of Insurance licenses producers and insurers, reviews insurance filings, and investigates complaints about insurance companies and agents.
