# Key Person Insurance in Idaho

Idaho residents receive up to $300,000 in state guaranty-association coverage for a life policy’s death benefit if a member insurer becomes insolvent. Because a key-person policy may exceed that backstop, identify the issuing insurer and size the benefit with the cap in view. Idaho requires a lawful, substantial economic interest in the other person’s continued life; a benefit arising only from death does not qualify. Connect the proposed benefit to a documented business loss rather than a general employee replacement cost. Compare your ownership and insured’s role with Idaho Code § 41-1804(1), (3)(b)–(c).[^4][^1]

## What Is Key Person?

Key person insurance pays the business, not the person’s family, when a founder, partner or employee it relies on dies. Disability, overhead expense and buyout funding are separate products to discuss on their own. [Read the national Key person guide](/coverage/key-person).

## What to Watch for in Idaho

### Document the Business Interest

Idaho requires a lawful, substantial economic interest in the other person’s continued life; a benefit arising only from death does not qualify. Connect the proposed benefit to a documented business loss rather than a general employee replacement cost.[^1]

### Complete Written Notice and Consent

Idaho requires an individual insured to apply or consent in writing unless a statutory exception applies. Ask the broker to confirm in writing which exception, if any, supports your employer-owned policy.[^2][^3]

### Check the State Guaranty Backstop

NOLHGA’s Idaho entry sets the reported death-benefit protection at $300,000. This is not a limit on the contract; ask the broker how it applies to your employer-owned benefit. Review it alongside the replacement-cost estimate for this insured. For issuance, also check Idaho Code § 41-1804(1), (3)(b)–(c).[^4][^5][^1]

## Who Regulates Insurance in Idaho

**Idaho Department of Insurance.** The Idaho Department of Insurance administers insurance laws and regulates insurers and licensed producers. It directs users to the NAIC State Based Systems lookup for producer and company licensing records and accepts consumer complaints.[^6][^10][^7]

- [Regulator website](https://doi.idaho.gov/)
- [License lookup](https://sbs.naic.org/solar-external-lookup/lookup)
- [File a complaint](https://doi.idaho.gov/consumers/)
- Phone: (208) 334-4250

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule. Surplus-lines policies do not receive Idaho guaranty-association protection.[^8][^9][^11]

## Providers With Documented State Licenses

These providers publish a national listing for Key person; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Idaho; [check the regulator’s license lookup](https://sbs.naic.org/solar-external-lookup/lookup) and confirm state availability for your business when requesting a quote.

- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^18]

## Questions to Ask Before You Buy in Idaho

1. What Idaho law supports our business’s insurable interest in this person, and what should we retain to prove the role?
2. What written notice and consent must the insured receive before this policy is issued, and can coverage continue after employment ends?
3. How would Idaho’s guaranty-association limit apply to this policy and our other business-owned life policies?

## Key Person in Idaho: FAQ

### How much of a key person life policy is protected if an insurer fails in Idaho?

NOLHGA’s latest state listing gives Idaho a $300,000 life-benefit amount. That is an insolvency backstop, not the face amount you can insure. NOLHGA reports an aggregate $5 million limit for one owner’s multiple nongroup life policies.[^4][^5]

### Does my business need an employee’s consent for key person insurance in Idaho?

Yes. Federal rules require written notice and consent before issue for the employer-owned life tax exception. Idaho requires an individual insured to apply or consent in writing unless a statutory exception applies. Ask the broker to confirm in writing which exception, if any, supports your employer-owned policy. Ask who will retain the consent and how the insured can access it. For state-law details, check Idaho Code § 41-1804(1), (3)(b)–(c).[^2][^3][^1]
