# Key Person Insurance in Alaska

For a life insurer failure, the published guaranty limit for a policy covering a life in Alaska is $300,000 in death benefits. Ask the broker which insurer will issue the policy and compare its financial strength separately from this limited state safety net. Alaska limits an employer’s interest to a lawful, substantial economic interest in the person continuing to live; a gain that arises only from the person’s death is not enough. Show the insurer why the person’s continued work protects revenue, delivery, or a specific contract. Compare your ownership and insured’s role with Alaska Stat. § 21.42.020(e)(2)–(3).[^4][^1]

## What Is Key Person?

Key person insurance pays the business, not the person’s family, when a founder, partner or employee it relies on dies. Disability, overhead expense and buyout funding are separate products to discuss on their own. [Read the national Key person guide](/coverage/key-person).

## What to Watch for in Alaska

### Document the Business Interest

Alaska limits an employer’s interest to a lawful, substantial economic interest in the person continuing to live; a gain that arises only from the person’s death is not enough. Show the insurer why the person’s continued work protects revenue, delivery, or a specific contract.[^1]

### Complete Written Notice and Consent

Alaska requires an adult insured to apply for or consent in writing to an individual life policy, with listed exceptions that do not generally fit employer-owned key-person insurance. Ask the carrier to retain the signed application or consent.[^2][^3]

### Check the State Guaranty Backstop

For Alaska, NOLHGA reports a $300,000 life death-benefit ceiling. Ask whether your other nongroup policies count toward the association’s owner-level aggregate. Include it in the ownership and beneficiary review. For issuance, also check Alaska Stat. § 21.42.020(e)(2)–(3).[^4][^5][^1]

## Who Regulates Insurance in Alaska

**Alaska Division of Insurance.** The Alaska Division of Insurance regulates insurers and insurance licensees, provides company and licensee searches, and investigates insurance complaints within its authority. Its consumer-services section handles disputes involving claims, cancellations, premium refunds, agents, and insurers.[^6][^7][^8]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.7% of gross premium less returns plus 1% filing fee; wet marine: 0.75%, no fee For covered property and casualty surplus-lines risks, Alaska lists a 2.7% tax and a separate 1% filing fee on gross premium less returned premium. Qualifying wet-marine and transportation policies instead carry a 0.75% tax on gross premium and no filing fee; risks of state or local government and certain interstate aircraft are exempt from both tax and fee. A multistate placement is regulated under the insured’s home-state rules, and Alaska says to evaluate each policy’s home state separately.[^10][^9][^11][^12]

**Alaska has a placement-list exception:** If a risk appears on Alaska’s surplus-lines placement list, the Division says the broker does not have to canvass admitted insurers for declinations before placement; the broker must document the applicable list entry.[^9]

**Alaska has limited tax and search exceptions:** The Division says qualifying wet-marine and transportation policies need no diligent search and pay no 1% filing fee. Tax and filing fees also do not apply to state or political-subdivision risks or qualifying interstate aircraft, although other placement requirements remain.[^13]

## Providers With Documented State Licenses

These providers publish a national listing for Key person; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Alaska; [check the regulator’s license lookup](https://www.commerce.alaska.gov/web/ins/Consumers/ConsumerTools/ResearchaCompany.aspx) and confirm state availability for your business when requesting a quote.

- [Vouch](/insurance-providers/vouch) — **Entity:** Vouch Specialty Insurance Services, LLC; **role:** Insurance producer, Surplus-lines broker; **checked:** 2026-09-28. **Scope:** Vouch’s licenses page, effective January 16, 2025, lists producer licenses in all 50 states and DC. Its separate surplus-lines table includes Idaho number 870820, while a footnote says Georgia and Idaho do not issue agency-level surplus-lines licenses. Because those statements conflict for Idaho, this record keeps Idaho producer-only and does not treat the table number as established agency surplus-lines authority. The page is company-reported and does not establish product availability.[^20]

## Questions to Ask Before You Buy in Alaska

1. What Alaska law supports our business’s insurable interest in this person, and what should we retain to prove the role?
2. What written notice and consent must the insured receive before this policy is issued, and can coverage continue after employment ends?
3. How would Alaska’s guaranty-association limit apply to this policy and our other business-owned life policies?

## Key Person in Alaska: FAQ

### How much of a key person life policy is protected if an insurer fails in Alaska?

NOLHGA lists $300,000 in death-benefit protection for a covered life in Alaska. That is an insolvency backstop, not the face amount you can insure. NOLHGA reports an aggregate $5 million limit for one owner’s multiple nongroup life policies.[^4][^5]

### Does my business need an employee’s consent for key person insurance in Alaska?

Yes. Federal rules require written notice and consent before issue for the employer-owned life tax exception. Alaska requires an adult insured to apply for or consent in writing to an individual life policy, with listed exceptions that do not generally fit employer-owned key-person insurance. Ask the carrier to retain the signed application or consent. Keep the signed record with the final policy. For state-law details, check Alaska Stat. § 21.42.020(e)(2)–(3).[^2][^3][^1]
