# Intellectual Property Insurance in New Jersey

New Jersey’s Trade Secrets Act recognizes threatened misappropriation, so a dispute can arise before the information is actually used. Ask whether your policy’s claim definition includes a cease-and-desist demand or an application for emergency relief.[^2]

**Coverage:** [Intellectual property](/coverage/intellectual-property) · [New Jersey](/coverage/states/new-jersey)

## What Is Intellectual Property?

Intellectual property insurance comes in two separate parts: defense, when you're accused of infringing a patent, trademark or copyright, and enforcement, when you pursue someone who copied yours. A defense-only quote doesn't pay for your own lawsuit, so ask for each part you need. [Read the national Intellectual property guide](/coverage/intellectual-property).

## What to Watch for in New Jersey

### Match the State Rule to Your Coverage

New Jersey’s Trade Secrets Act recognizes threatened misappropriation, so a dispute can arise before the information is actually used. Ask whether your policy’s claim definition includes a cease-and-desist demand or an application for emergency relief.[^2]

### Plan for the State Remedy

New Jersey permits recovery for actual loss and unjust enrichment, with a reasonable royalty when those measures are not adequate. Ask how the limit applies if a claimant seeks both lost profits and a license payment.[^2]

### Check the Policy Against the Claim

New Jersey preserves contractual remedies alongside its statutory trade-secret claim. Keep nondisclosure and IP-assignment agreements organized, then ask whether contract allegations arising from the same facts are covered with the trade-secret defense.[^2]

## Who Regulates Insurance in New Jersey

**New Jersey Department of Banking and Insurance.** New Jersey DOBI licenses insurers and producers, reviews insurance products and rates, monitors insurer solvency and responds to insurance complaints. The Property and Casualty unit regulates commercial and personal property and casualty rates, rules and forms.[^3][^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, less return premium New Jersey’s Department of Banking and Insurance states a 5% surplus-lines tax for policies effective on or after July 1, 2009; its FAQ also describes direct-procurement tax filing for premium allocated to New Jersey. A New Jersey surplus-lines producer generally must make a diligent effort to place the risk with authorized insurers, subject to the exportable-list and other statutory exceptions. New Jersey’s separate surplus-lines guaranty fund has narrow coverage; ordinary commercial surplus-lines claims are generally outside guaranty protection.[^7][^8][^9]

## Providers With Documented State Licenses

These providers publish a national listing for Intellectual property; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in New Jersey; [check the regulator’s license lookup](https://www.nj.gov/dobi/inslic.htm) and confirm state availability for your business when requesting a quote.

- [Risklytics](/insurance-providers/risklytics) — **Entity:** Risklytics, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Risklytics’ licensing page lists its Massachusetts resident agency license plus state license records in Arizona, Colorado, Illinois, Indiana, New Jersey, Ohio, Texas and Washington; it identifies the NPN record date as September 10, 2026. This list is company-published and not a product availability map.[^15]

## Questions to Ask Before You Buy in New Jersey

1. Will this policy cover a threatened trade-secret claim under New Jersey law before a lawsuit is filed?
2. Do defense costs reduce the limit available for a royalty settlement or damages?
3. What records should we preserve to establish when a suspected New Jersey misappropriation was discovered?

New Jersey’s Trade Secrets Act recognizes threatened misappropriation, so a dispute can arise before the information is actually used. Ask whether your policy’s claim definition includes a cease-and-desist demand or an application for emergency relief.[^2]

### How should I handle a suspected intellectual-property claim in New Jersey?

Notify the insurer promptly and preserve the first demand, access logs, agreements, and discovery date. New Jersey preserves contractual remedies alongside its statutory trade-secret claim.
