# Intellectual Property Insurance in Maine

Maine Technology Institute records are not automatically confidential: after a written application or proposal is received, a related record must fit a separate statutory category, and a proprietary-information claim requires both a confidentiality request and the Institute’s determination of competitive harm. Some records remain public, including identifying patent and copyright information unless disclosure would place an applicant or recipient at a competitive disadvantage.[^1][^2]

**Coverage:** [Intellectual property](/coverage/intellectual-property) · [Maine](/coverage/states/maine)

## What Is Intellectual Property?

Intellectual property insurance comes in two separate parts: defense, when you're accused of infringing a patent, trademark or copyright, and enforcement, when you pursue someone who copied yours. A defense-only quote doesn't pay for your own lawsuit, so ask for each part you need. [Read the national Intellectual property guide](/coverage/intellectual-property).

## What to Watch for in Maine

### Request MTI Confidentiality With The Submission

Maine law lets the Technology Institute designate requested records confidential only after it determines that specified proprietary, trade-secret, or commercial information could competitively harm the submitter, impair future voluntary submissions, and affect Institute interests. After a written application arrives, other application records are not confidential unless another listed category applies; identify the exact IP and request treatment in the application process.[^1]

### Account For Public Patent And Copyright Reporting

Maine requires MTI to provide certain information on request, including patent and copyrightable-work counts and identifying information, except where disclosure would place an applicant or recipient at a competitive disadvantage. Ask what patent and product details will appear in public grant records and align the submission with your IP-protection and insurance application records.[^1]

### Maintain Secrecy Evidence For A Claim

Maine’s Trade Secrets Act requires economic value from secrecy and reasonable secrecy efforts; courts must preserve alleged secrets through reasonable measures such as protective orders, in-camera hearings, sealed records, and nondisclosure orders. Ask whether the policy’s defense costs for confidential discovery erode limits and how the named insured’s counsel coordinates with insurer-appointed counsel.[^2]

## Who Regulates Insurance in Maine

**Maine Bureau of Insurance.** The Maine Bureau of Insurance licenses producers and companies, enforces Maine insurance laws, and investigates property and casualty complaints including commercial coverage complaints. You can use its state lookup or complaint service to check a license or raise an insurance issue.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross direct premium when Maine is the insured's home state Maine charges 3% of gross direct premium when it is the insured's home state; your broker handles the tax and may include it with the premium. Surplus-lines policies are outside Maine guaranty-association protection. Maine generally requires a diligent search, with an exempt-commercial-purchaser exception requiring broker disclosure and the purchaser's written request.[^7][^8][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www1.maine.gov/pfr/insurance/node/3) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Maine

1. Which exact technical or commercial records will we ask Maine Technology Institute to designate confidential, and what competitive harm supports the request?
2. Could a patent, copyrightable work, or project description appear in public MTI reporting, and which details would create a competitive disadvantage?
3. How does the quote treat defense costs for sealed filings, protective orders, and confidential technical discovery in a Maine trade-secret action?

## Intellectual Property in Maine: FAQ

### Are Maine Technology Institute application records confidential?

Not automatically. After a written application or proposal arrives, related records are confidential only if they fit another listed category; a proprietary-information request needs an Institute determination of specified competitive harm and other statutory interests.[^1]

### Can Maine Technology Institute disclose patent information about a funded company?

Yes, certain patent and copyrightable-work counts and identifying information are public on request unless disclosure would place an applicant or recipient at a competitive disadvantage.[^1]

### How long can a Maine trade-secret injunction last?

A court must end an injunction when the trade secret ceases to exist, but may continue it for a reasonable additional period to eliminate a commercial advantage; in exceptional circumstances it may allow future use for a reasonable royalty instead.[^3]
