# Intellectual Property Insurance in Louisiana

Louisiana gives a specific public-record process to trade-secret material submitted for approval to sell or use a code, pattern, formula, design, device, method, or process; material submitted for further research or commercialization; and information submitted to Louisiana Economic Development. A submitter must use a prescribed bold cover sheet and mark each claimed item, while identity, contracts, and nonsecret record portions remain public.[^1][^2]

La. R.S. 44:3.2(A)-(C) covers qualifying material submitted to a public body for approval to sell or use a specified technology/process, to facilitate further research, development, or commercialization, or to Louisiana Economic Development for economic-development purposes. It is not a blanket exemption for every public contract; match your product and recipient to the subsection.[^1]

For records within §44:3.2(A)-(C), the developer, owner, or manufacturer must attach the bold cover sheet “DOCUMENT CONTAINS CONFIDENTIAL PROPRIETARY OR TRADE SECRET INFORMATION” and mark each claimed instance. The custodian determines status within 30 days, subject to a shorter records-request timetable; retain the filed copy and ask who will monitor disclosure notices.[^1]

### Plan For Public Identity And Contract Terms

Even when the section applies, general information identifying the developer, owner, or manufacturer and its public-body agreement is public, as are nonsecret portions of a record. Ask what IP and contract details will remain visible, and compare the policy’s treatment of disclosure and third-party misappropriation allegations separately.[^1][^2]

## Who Regulates Insurance in Louisiana

**Louisiana Department of Insurance.** The Louisiana Department of Insurance licenses producers and insurers, reviews insurance filings, and investigates complaints about insurance companies and agents. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.85% of gross premium plus a 0.175% SLIP+ transaction fee for policies effective on or after July 1, 2026 For Louisiana-home-state policies effective on or after July 1, 2026, the state charges 4.85% of gross premium plus a 0.175% SLIP+ transaction fee, which your broker may add to your bill. Louisiana's required policy disclosure says these policies are not covered by the Louisiana Insurance Guaranty Association; state placement and filing rules still apply.[^6][^7]
