# Intellectual Property Insurance in Arizona

Arizona’s dilution statute protects a mark only if it is famous in the state, and generally limits relief to an injunction unless the defendant willfully intended to trade on the mark’s reputation or cause dilution. If your brand depends on Arizona recognition or your business relies on confidential know-how, separate trademark, trade-secret, and copyright allegations when you review defense and enforcement wording.[^1][^2]

**Coverage:** [Intellectual property](/coverage/intellectual-property) · [Arizona](/coverage/states/arizona)

## What Is Intellectual Property?

Intellectual property insurance comes in two separate parts: defense, when you're accused of infringing a patent, trademark or copyright, and enforcement, when you pursue someone who copied yours. A defense-only quote doesn't pay for your own lawsuit, so ask for each part you need. [Read the national Intellectual property guide](/coverage/intellectual-property).

## What to Watch for in Arizona

### Arizona Dilution Requires State Fame

A mark must be famous in Arizona, and the statute lists in-state distinctiveness, use, advertising, territory, trade channels, and public recognition as factors. A business seeking enforcement should ask whether its policy includes its own enforcement expenses and whether it distinguishes a state dilution theory from defense against an infringement demand.[^1]

### Dilution Relief Is Usually an Injunction

For an Arizona dilution claim, the statute provides only injunctive relief unless the defendant willfully intended to trade on the mark’s reputation or cause dilution; comparative advertising, noncommercial use, and news reporting or commentary are excluded. Ask how the policy treats defense expenses and any requested injunction because the law does not establish insurance coverage.[^1]

### Document Secrecy Measures for Know-How

Arizona displaces conflicting state tort and restitutionary civil remedies based on trade-secret misappropriation, but preserves contract remedies and independent civil claims. If your confidential information also appears in an NDA, customer agreement, or vendor contract, ask whether the policy treats each asserted theory as a covered claim or exclusion.[^2][^3]

## Who Regulates Insurance in Arizona

**Arizona Department of Insurance and Financial Institutions.** Arizona DIFI regulates insurance companies and insurance professionals, including producers and surplus-lines brokers. Its license search covers both individual or business licensees and insurance companies, and its complaint page explains how to file with the Department.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium and taxable policy fees, less returns; stamping fee rate not verified When Arizona is the insured’s home state, the tax is 3% of gross premium and taxable policy fees, less returned premium; the statute excludes stamping fees from that tax base. For a multistate risk, Arizona’s share is allocated by exposure under the statute. Arizona's surplus-lines policy notice says these policies do not receive guaranty-fund protection. Current stamping-fee amount was not independently confirmed from readable current evidence and is omitted.[^7][^9][^11][^12]
[The Surplus Line Association of Arizona](https://www.sla-az.org/)

**Arizona has an exempt-commercial-purchaser search exception:** A surplus-lines broker generally must make diligent effort to place an Arizona risk in the admitted market. For an exempt commercial purchaser, federal law removes that search only after the broker discloses the admitted-market protection difference and the purchaser then asks in writing for nonadmitted coverage.[^8][^10]

## Providers With Documented State Licenses

These providers publish a national listing for Intellectual property; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Arizona; [check the regulator’s license lookup](https://difi.az.gov/license-search) and confirm state availability for your business when requesting a quote.

- [Risklytics](/insurance-providers/risklytics) — **Entity:** Risklytics, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Risklytics’ licensing page lists its Massachusetts resident agency license plus state license records in Arizona, Colorado, Illinois, Indiana, New Jersey, Ohio, Texas and Washington; it identifies the NPN record date as September 10, 2026. This list is company-published and not a product availability map.[^18]

## Questions to Ask Before You Buy in Arizona

1. Does the policy defend Arizona trade-secret and famous-mark dilution allegations, and how does it define those claims?
2. Does it pay your own costs to enforce a mark, or only defense costs when someone accuses you?
3. What records should we keep about Arizona use, recognition, licensing, and secrecy practices for the rights we want insured?

## Intellectual Property in Arizona: FAQ

### Does Arizona’s dilution law protect every business trademark?

No. The statute applies to a mark famous in Arizona, and courts may weigh its distinctiveness, in-state use, advertising, trading territory, channels, and recognition. It generally allows an injunction unless willful intent is proved.[^1]

### What does Arizona require for information to count as a trade secret?

It must derive independent economic value from not being generally known or readily ascertainable, and be subject to reasonable efforts to maintain secrecy. Ask your broker how the policy defines covered trade-secret claims; the statutory test does not itself establish insurance response.[^2]
