# Washington inland marine insurance, separate from ocean marine rating

Washington defines marine and transportation insurance to include cargo connected with transit, including preparation, delay, and storage, and it names bridges, tunnels, piers, dry docks, and dams and appurtenant waterway controls. The rating chapter does not apply to vessels, their cargoes, marine builders' risks, marine protection and indemnity, and other risks commonly insured under marine, as distinguished from inland marine, contracts. Inland marine that is written to manual or class rates still has a filing rule, except individually rated risks that by custom are not written to a manual.[^1][^2][^3]

## What to Watch for in Washington

### Ocean Marine and Inland Marine Are Not the Same Rating Exemption

RCW 48.19.010(1)(e) removes insurance of vessels, their cargoes, marine builders' risks, marine protection and indemnity, and other risks commonly insured under marine, as distinguished from inland marine, insurance contracts, as the commissioner may define by ruling. An inland marine equipment floater does not get that vessel exemption. Ask which contract you are buying.[^2]

### Manual Inland Marine Rates Are Filed

RCW 48.19.030(1) requires manual or class rates for the part of marine and transportation insurance that is not exempt under RCW 48.19.010, except specific rates on inland marine risks individually rated, which are not reasonably susceptible to manual rating and which by general custom are not written according to manual rates. A contractors' equipment class with a manual is not that exception.[^3]

### Dams, Piers, and Bridges Are Named, With Building Exclusions

RCW 48.11.050(1)(d) includes bridges, tunnels, and other instrumentalities of transportation, excluding buildings, their furniture and furnishings, fixed contents, and supplies held in storage, plus piers, wharves, docks and slips, dry docks and marine railways, and dams and appurtenant facilities for the control of waterways. Ask whether a building or stored supplies on the project are outside that clause and need another form.[^1]

## Who Regulates Insurance in Washington

**Washington State Office of the Insurance Commissioner.** The Washington State Office of the Insurance Commissioner administers Washington insurance laws, oversees insurers and insurance producers within its authority, and provides regulatory and consumer resources. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2% of premium The NAIC's state chart lists a 2% of premium charge for surplus-lines coverage for Washington (the chart's state entries were reviewed in October 2025). Your broker may collect the applicable amount with the premium. Surplus-lines insurers are not licensed in the state and generally are outside state guaranty-association protection; ask your broker to explain the insurer's financial protections and any diligent-search requirement that applies to your placement.[^7][^8]
