# Texas inland marine insurance: commercial exemption and personal prior approval

TDI's commercial inland marine checklist, updated November 10, 2021, says some inland marine classes are non-filed and tells filers to use the Texas definition in 28 TAC §§ 5.5001–5.5008 to decide. The May 2025 Filings Made Easy guide lists commercial inland marine as exempt from Insurance Code chapter 2301 form filing and chapter 2251 rate filing. It lists personal inland marine as prior approval for forms and file-and-use for rates. The current rule text on the Texas Register viewer did not open.[^1][^2]

**Coverage:** [Tools, equipment and inland marine](/coverage/inland-marine) · [Texas](/coverage/states/texas)

## What Is Tools, Equipment And Inland Marine?

If your business moves equipment between sites or ships goods, inland marine can cover those property exposures; installation and other forms address different property categories. Match the quote to what you own, rent or hold for others. [Read the national Tools, equipment and inland marine guide](/coverage/inland-marine).

## What to Watch for in Texas

### Non-Filed Commercial Classes Depend on the Rule Definition

The checklist says some classes of inland marine are non-filed and points filers to 28 TAC §§ 5.5001–5.5008. Those rule sections did not open on the current register viewer, so this guide does not restate their subclasses. Ask the insurer which section it used to call your equipment or shipment non-filed, and read the form for theft, transit, and premises terms.[^1]

### Personal Inland Marine Forms Are Prior Approval

The May 2025 Filings Made Easy guide lists personal inland marine as prior approval for forms and file-and-use for rates. A personal article floater is not on the commercial exemption. Ask which track the quote is on before you compare it with a contractors' equipment policy.[^2]

### Commercial Inland Marine Is Exempt From Two Filing Chapters

The same guide lists commercial inland marine as exempt from chapter 2301 form filing and chapter 2251 rate filing. An exemption from filing is not an exemption from exclusions. Ask for the issued form even when TDI did not have to approve it.[^2]

## Who Regulates Insurance in Texas

**Texas Department of Insurance.** TDI licenses agents and insurers, reviews company rate filings, and investigates complaints against insurance companies and people it regulates. Its complaint page states limits on what it can resolve, including disputes outside its regulatory authority.[^3][^4][^5]

- [License lookup](https://www.tdi.texas.gov/agent/agent-lookup.html)
- [File a complaint](https://www.tdi.texas.gov/consumer/complaint-home.html)

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.85% of gross premium plus 0.04% SLTX stamping fee When Texas is the insured’s home state, the state tax is 4.85% of gross premium; absent a compact allocation agreement, a multistate policy can be taxed on its entire premium. Policies effective on or after Jan. 1, 2024 also carry a 0.04% stamping fee; SLTX invoices the broker and says the insured pays it, and the surplus-lines insurer is not covered by the Texas guaranty association.[^6][^7][^8]

## Providers With Documented State Licenses

These providers publish a national listing for Tools, equipment and inland marine; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Texas; [check the regulator’s license lookup](https://www.tdi.texas.gov/agent/agent-lookup.html) and confirm state availability for your business when requesting a quote.

- [Risklytics](/insurance-providers/risklytics) — **Entity:** Risklytics, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Risklytics’ licensing page lists its Massachusetts resident agency license plus state license records in Arizona, Colorado, Illinois, Indiana, New Jersey, Ohio, Texas and Washington; it identifies the NPN record date as September 10, 2026. This list is company-published and not a product availability map.[^14] **Coverage membership:** Risklytics arranges inland marine equipment coverage for robotics, hardware and AI businesses.
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^15] **Coverage membership:** TechInsurance arranges inland marine coverage for contractors’ tools and equipment.
