# Pennsylvania inland marine insurance and the deleted installment-sales class

Pennsylvania's Insurance Department adopted the Nation Wide Definition of marine insurance that the NAIC adopted on June 12, 1953. Chapter 91 of the Pennsylvania Code still prints an installment-sales and leased-property floater. Section 112.3 says that class was deleted from the marine definition and must be rate-filed. Use the deletion, not the older chapter sentence, when a lender or lessor asks for a floater.[^1][^2]

## What to Watch for in Pennsylvania

### Installment Sales and Leased Property Left the Marine Definition

The opened chapter 91 text still contains § 91.8(b)(12), which says installment-sales and leased-property policies shall cover property in transit, shall not extend beyond termination of the seller's or lessor's interest, and may not cover certain property. Section 112.3 says that class was deleted from the marine definition and must be rate-filed. If a lessor asks you to insure leased equipment as inland marine, ask whether the current rule still allows that class.[^1][^2]

### The Adopted Definition Is the 1953 Text

Section 91.1 says the Department adopted the Nation Wide Definition of marine insurance adopted by the NAIC on June 12, 1953, in San Francisco. That is an older text than the 1976 definition some other states cite. Do not substitute another state's 1976 subclasses for a Pennsylvania filing question.[^1]

### If the Old Floater Sentence Still Describes Your Form, Stop at the Lessor's Interest

Where a form still follows the chapter 91 installment or leased-property wording, transit coverage is part of the class and coverage is not supposed to outlast the seller's or lessor's interest. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium (2% for eligible surplus-lines risk retention groups) Pennsylvania charges 3% of gross surplus-lines premiums (2% for an eligible surplus-lines risk-retention group); the tax is in addition to premium, is borne by the insured, and is collected by the producer.
