# Ohio inland marine insurance and the manual-rate filing exception

Ohio Administrative Code 3901-1-23 establishes inland marine risks by the nationwide inland marine definition the NAIC approved on December 9, 1976. A company that wants to deviate must file and get the superintendent's approval before using the deviation. Separately, Ohio Rev. Code § 3935.04, effective October 24, 2024, says the usual form and rate filing duty does not apply to inland marine risks which by general custom are not written according to manual rates or rating plans.[^1][^2]

## What Is Tools, Equipment And Inland Marine?

If your business moves equipment between sites or ships goods, inland marine can cover those property exposures; installation and other forms address different property categories. Match the quote to what you own, rent or hold for others. [Read the national Tools, equipment and inland marine guide](/coverage/inland-marine).

## What to Watch for in Ohio

### A Deviation From the 1976 Definition Needs Approval

Rule 3901-1-23 does not reprint consignment, installation, or equipment subclasses. It says inland marine risks shall be established by the December 9, 1976 nationwide definition, and that any company wishing to deviate shall make a formal filing and obtain the superintendent's approval before using the deviation. The rule's five-year review date is August 31, 2027. Ask whether your class is inside the definition or under an approved deviation.[^1]

### Non-Manual Inland Marine Skips the Ordinary Filing Duty

Section 3935.04(A) requires filing of forms and rates except as to inland marine risks which by general custom are not written according to manual rates or rating plans. Specific inland marine rates on risks specially rated by a rating bureau shall be filed, and those bureau-made rates become effective when filed. Division (J)'s ban on issuing a policy except in accordance with filings in effect does not apply to inland marine risks as to which filings are not required.[^2]

### The Filing Exception Is Not a Coverage Term

A risk that does not have to be filed can still exclude theft from an unattended vehicle, tools over a sublimit, or property at your premises. Ask the broker to point to the form's transit, jobsite, and premises clauses. The authorized-kinds statute lists inland marine but does not define those subclasses.[^2][^1]

## Who Regulates Insurance in Ohio

**Ohio Department of Insurance.** ODI licenses insurance agents and agencies and provides a public agent and company locator. Its consumer complaint form accepts insurance complaints and lets you identify an agent or company.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, net of return premiums For Ohio-home-state surplus-lines placements, Ohio sets a 5% tax on gross premiums after returned premiums and requires the surplus-lines broker to collect it when the policy is delivered. A diligent search usually applies; a qualifying exempt commercial purchaser may request nonadmitted placement in writing after disclosure that authorized-market coverage may offer greater protection, and the policy requires a signed notice of no Ohio guaranty-association benefits.[^6][^7][^8]

## Providers With Documented State Licenses

These providers publish a national listing for Tools, equipment and inland marine; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Ohio; [check the regulator’s license lookup](https://gateway.insurance.ohio.gov/UI/ODI.Agent.Public.UI/AgentSearch.mvc/DisplaySearch) and confirm state availability for your business when requesting a quote.

- [Risklytics](/insurance-providers/risklytics) — **Entity:** Risklytics, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Risklytics’ licensing page lists its Massachusetts resident agency license plus state license records in Arizona, Colorado, Illinois, Indiana, New Jersey, Ohio, Texas and Washington; it identifies the NPN record date as September 10, 2026. This list is company-published and not a product availability map.[^14] **Coverage membership:** Risklytics arranges inland marine equipment coverage for robotics, hardware and AI businesses.
- [TechInsurance](/insurance-providers/techinsurance) — **Entity:** Specialty Program Group LLC; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** TechInsurance’s current licensing page names Specialty Program Group LLC / SPG Insurance Solutions and lists state license numbers, but labels Rhode Island “Individual licenses” rather than identifying a license for the named agency. RI is omitted because this disclosure does not establish agency authority there; this is a search limitation, not an assertion that the company is unlicensed. The remaining state entries are company-reported and are not an insurance product availability map.[^15] **Coverage membership:** TechInsurance arranges inland marine coverage for contractors’ tools and equipment.

## Questions to Ask Before You Buy in Ohio

1. Is this class inside the 1976 definition, or under a deviation the superintendent approved?
2. Are the rates manual or bureau-made specific rates that had to be filed?
3. Where does cover stop: in transit, at a job site, or at your premises?

## Tools, Equipment And Inland Marine in Ohio: FAQ

### Can an Ohio insurer use an inland marine class outside the 1976 definition without approval?

No. Rule 3901-1-23 requires a formal filing and the superintendent's approval before a company uses a deviation from the nationwide inland marine definition approved on December 9, 1976.[^1]

### Must every Ohio inland marine policy be issued only on a filing that is in effect?

No. Section 3935.04(J) does not apply to inland marine risks as to which filings are not required. Bureau-made specific rates on specially rated inland marine risks are filed and become effective when filed.[^2]
