Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ### West Virginia includes permissive users in covered auto policies

Section 33-6-31(a) requires coverage for a person using or responsible for use with express or implied consent, subject to exclusions. Have employees obtain permission before using a personal or borrowed vehicle for company work.[^1]

### Consent for a non-owned car may come from its custodian

If a policy conditions non-owned-auto coverage on the owner’s consent, § 33-6-31 treats “owner” as including the custodian of the non-owned vehicle. Confirm who controls the vehicle and whether the employee has that person’s authorization.[^1]

### An excluded driver can remove coverage entirely

West Virginia permits restrictive endorsements for specifically excluded drivers; § 33-6-31h says the insurer need not defend or indemnify for that person’s vehicle use. Ask employees to disclose named-driver exclusions and verify HNOA can still protect the employer.[^2]
