# Texas Hired and Non-Owned Auto Coverage

Texas statutes expressly distinguish an owner’s policy, which covers permitted use of listed vehicles, from an operator's policy, which covers the named insured’s liability in a vehicle they do not own. Ask whether your employees' vehicles meet the policy definition and how the HNOA layer coordinates with their own coverage.[^2][^1]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in Texas

### Texas owner policies identify covered autos

Section 601.076 requires an owner’s policy to cover each vehicle for which coverage is granted and permitted users of those vehicles. An employee’s personal policy may not be a catch-all for every borrowed or rented vehicle; verify policy wording and use.[^1]

### Texas has a statutory operator-policy path

Under § 601.077, an operator policy covers the named insured’s liability from use of a vehicle they do not own, under the owner-policy limits and exclusions. Ask whether the employee has this form of policy and whether company HNOA is excess or primary.[^2]

### Workers’ compensation liability is outside the auto policy requirement

Chapter 601 excludes workers’ compensation liability from required auto-policy terms. Keep the employee’s injury benefits separate from third-party liability coverage and confirm workers’ compensation applies to business driving.[^2]

## Who Regulates Insurance in Texas

**Texas Department of Insurance.** TDI licenses agents and insurers, reviews company rate filings, and investigates complaints against insurance companies and people it regulates. Its complaint page states limits on what it can resolve, including disputes outside its regulatory authority.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.85% of gross premium plus 0.04% SLTX stamping fee When Texas is the insured’s home state, the state tax is 4.85% of gross premium; absent a compact allocation agreement, a multistate policy can be taxed on its entire premium. Policies effective on or after Jan. 1, 2024 also carry a 0.04% stamping fee; SLTX invoices the broker and says the insured pays it, and the surplus-lines insurer is not covered by the Texas guaranty association.[^6][^7][^8]

Yes. Section 601.077 requires an operator policy to cover the named insured’s liability from use of a non-owned motor vehicle, subject to the owner-policy limits and exclusions.[^2]
