# South Carolina Hired and Non-Owned Auto Coverage

South Carolina requires auto liability policies to protect the named insured and people using or responsible for a vehicle with express or implied consent. ## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in South Carolina

### South Carolina policies include permissive users

Section 38-77-142 requires liability coverage for the named insured and another person using or responsible for use of the vehicle with express or implied consent. Set written rules for employee-owned car use and ask whether the business policy also covers the employer’s liability.[^1]

### There is no mandated PIP layer

Section 38-77-144 says South Carolina does not mandate PIP. An employee hurt while driving for work may need a different first-party benefit path; ask how workers’ compensation and any auto medical-payments coverage coordinate.[^2]

### South Carolina gives vehicle-service policies a primary rule

Section 38-77-143 makes policies for maintaining, selling, repairing, servicing, storing, or parking autos primary. That special rule is not a general employer HNOA priority rule; ask the broker which other-insurance terms apply to your organization.[^1]
