# New Hampshire’s statutory non-owned coverage is limited to named insureds

New Hampshire’s statutory motor-vehicle liability policy extends liability protection for use of non-owned vehicles to the named insured, qualifying household relatives and a domestic servant, and only if no other valid and collectible insurance is available. A separate statute can require security and future financial-responsibility proof after the state receives a specified accident report, subject to exceptions. ## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in New Hampshire

### A specified accident report can trigger security and future proof

RSA 264:3 applies after the director receives a report required by RSA 264:25 and can suspend the involved driver’s license and vehicle registration until required security for possible judgments and future financial-responsibility proof are provided. RSA 264:6 lists exceptions, including nonconsensual use, an accident the owner or driver did not cause or contribute to, and certain criminal acts by a third party. Do not treat the post-accident process as a statement about coverage in the business policy.[^1][^3]

### The statutory non-owned provision covers a limited set of insured people

RSA 259:61 extends a qualifying motor-vehicle liability policy to the named insured, their spouse or resident relatives, and a domestic servant acting within that insured’s household employment when they use a vehicle they do not own. The statute does not name an ordinary business employee as an insured under an employer policy. Confirm the business policy’s actual insured-person wording.[^2]

### Statutory non-owned protection applies only when no other valid insurance is available

The non-owned-vehicle protection in RSA 259:61(II) applies only if no other valid and collectible insurance is available to the insured. That is a legal condition for the statutory policy described there, not a rule that determines priority for every employer HNOA policy. Ask the business insurer for the exact other-insurance clause and whose liability it covers.[^2]

### The statutory policy excludes specified employee injury and property claims

RSA 259:61(I) excludes bodily-injury claims by employees actually operating the vehicle and people entitled to workers’ compensation benefits, and excludes damage to property of others in the charge of the insured or employees. These are terms in the statutory policy definition; do not infer that all HNOA forms have identical exclusions or coverage. Compare the relevant policy and workers’ compensation response.[^2]
