# When Maryland’s rental auto rules matter to business drivers

For Maryland rentals, the vehicle’s required policy or self-insurance generally provides primary coverage to the owner, lessee and permitted users; commercial-use and long-term leases can shift security duties under specified conditions. Those rules do not establish what a business HNOA policy covers, so check both the rental agreement and the actual business policy.[^1][^2]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in Maryland

### Permitted drivers have a statutory primary-policy rule

Maryland requires a vehicle-rental or lease business to provide its required liability policy or self-insurance to the owner, lessee and each person using the vehicle with permission. The regulation says this primary coverage applies despite contrary terms in the rental agreement. It describes the rental vehicle’s required security; it does not say your separate HNOA policy insures the business or every employee.[^1]

### An employee outside the rental authorization is a distinct risk

For rental transactions originating in Maryland, the rental company must provide required security on a primary basis for a third-party liability claim when the driver is neither the renter nor an authorized driver. Confirm how the company adds employees as authorized drivers, and ask the HNOA broker separately how its policy treats a driver who is not on the rental agreement.[^2]

### Commercial and long-term leases can allocate security differently

For a commercial-use lease, the lessor may require the lessee to procure security only if the lessor has an approved contingent-liability and matching uninsured-motorist arrangement, approved self-insurance, or a qualifying bond on file for lessee default. For leases longer than 180 days, the owner may require the lessee to procure security. Check the contract term, proof requirements and default backstop before treating a fleet lease like a short rental.[^1]

### An employee’s personal policy may limit permissive-driver limits

Maryland’s Insurance Administration says a personal auto policy issued and delivered in the state may reduce a non-household permissive driver’s liability limit to the state minimum; household drivers may also face policy-specific limits if unlisted. That regulator guidance concerns personal auto contracts, not the company’s HNOA policy. Ask employees and the broker about policy terms rather than assuming an employee’s personal limit will be the business’s limit.[^3]

## Who Regulates Insurance in Maryland

**Maryland Insurance Administration.** The Maryland Insurance Administration licenses producers and insurers, reviews rates and forms, and investigates complaints about insurance companies and producers. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums when Maryland is the insured's home state; excludes risks of Maryland and its political subdivisions When Maryland is the insured's home state, the tax is 3% of gross premiums less returned premiums, except insurance of risks of the State or a political subdivision. For policies effective on or after July 21, 2011, Maryland taxes the entire premium and the broker must charge the tax in addition to premium.
