# Indiana Hired and Non-Owned Auto Coverage

Indiana requires financial responsibility to be in effect for a motor vehicle operated on public roads, or the operator must otherwise be insured. For a BMV request tied to a past incident, the bureau provides a separate affidavit for a driver who was operating an employer-owned or rental vehicle in the course of employment or rental term. The affidavit relieves the driver from that BMV proof requirement; it does not insure the driver, establish who is liable, or decide whether any policy covers the claim.[^4][^2]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ### Employer and rental vehicles have a proof pathway

Indiana BMV Form 55434 is described as relieving a driver from the BMV’s proof-of-financial-responsibility requirement when the driver was operating an employer-owned or rental vehicle during employment or the rental term. It is a proof procedure for the BMV; it does not state that a policy covers the trip or that no one is liable.[^2]

### Indiana recognizes vehicle or operator financial responsibility

Indiana Code § 9-25-4-4 measures financial responsibility with respect to the vehicle when a qualifying policy, bond, or self-insurance can respond to liability from ownership, maintenance, or use. Indiana’s BMV separately says a person may be otherwise insured to operate the vehicle. Ask the broker to identify the applicable policy and insured status for this driver and trip.[^1][^4][^3]

### A proof request is separate from the claim

The BMV says it requests proof after listed events such as an accident or certain traffic violations; its COC process documents whether insurance applied to a specific vehicle and incident. Provide the requested form through the prescribed process, while separately reporting any claim to the employer and insurers.[^3]

## Who Regulates Insurance in Indiana

**Indiana Department of Insurance.** The Indiana Department of Insurance licenses and regulates insurance companies and producers, reviews rates and policies, and investigates consumer complaints. ### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2.5% of gross premium when Indiana is the home state Indiana’s surplus-lines premium tax is 2.5% when Indiana is the insured’s home state.
