# Illinois Hired and Non-Owned Auto Coverage

Illinois requires liability insurance on public-highway motor vehicles and prohibits an owner from permitting an uninsured vehicle to be operated. The Vehicle Code also sets a specific annual certification process for state employees assigned a state-owned or state-leased vehicle on an ongoing basis: they must attest to liability coverage during nonofficial use or file a bond. That state-agency rule does not apply to every private employer, and neither provision determines whether a separate HNOA policy covers a particular work trip.[^1][^2]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in Illinois

### The mandate follows the vehicle

625 ILCS 5/7-601 applies to operating, registering, or maintaining registration of a public-highway motor vehicle and expressly prohibits an owner from permitting another person to operate it unless the vehicle is covered. For an employee using a personally owned or borrowed vehicle, clarify who maintains the vehicle policy and what work-use terms apply.[^1]

### Illinois sets a specific rule for assigned state vehicles

A state-agency employee assigned a state-owned or state-leased vehicle on an ongoing basis must certify annually that the employee has liability insurance for nonofficial use or has filed a bond; authorization ends if the required coverage or bond ends. This rule addresses state employees and is not a general certification mandate for private employers.[^1]

### Registration checks do not decide a work-trip claim

The Secretary of State says it verifies liability insurance for registered vehicles at least twice a year, with an unresolved verification potentially leading to a registration-suspension letter. That is an owner’s registration compliance process, not a determination of which policy pays a work-trip claim.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3.5% of taxable premium plus a 0.04% stamping fee; separate 1% fire marshal tax on taxable fire premium When Illinois is the insured’s home state, the broker reports and remits a 3.5% tax on gross taxable surplus-line premium less returned taxable premium. **Illinois guaranty fund limits:** For covered claims against a member insurer, the Illinois Insurance Guaranty Fund generally caps its obligation at $500,000 per claim; workers’ compensation claims are excepted from that dollar cap. This fund does not protect policies issued by nonadmitted surplus-lines insurers. The net-worth exclusions apply to covered claims against member insurers.[^8]
