# Idaho Hired and Non-Owned Auto Coverage

Idaho’s required owner-policy provisions include people using a described vehicle with the named insured’s express or implied permission. A separate statute makes the operator’s policy primary when an insured operator negligently uses a qualifying loaned vehicle provided free by a licensed dealer for a demonstration or while the operator’s vehicle is being repaired or serviced. The owner’s policy is secondary or excess under that narrow rule; compensation for use generally shifts the stated order. The provision does not automatically cover ordinary rentals or every borrowed work vehicle.[^1][^2]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in Idaho

### The priority rule covers a defined loaner

Idaho Code § 49-1212(11) makes the operator’s qualifying motor vehicle liability policy primary for injury, death, or personal-property damage from negligent operation of a free temporary loaner supplied by a chapter 16 licensed entity to demonstrate a vehicle or provide convenience while the operator’s vehicle is being repaired or serviced. It does not apply to every non-owned work vehicle.[^1]

### Payment can change the priority order

If the owner receives compensation from or for the operator for temporary use, the owner’s coverage is primary and the operator’s is secondary or excess; compensation provided because the operator’s vehicle is being repaired or serviced is excluded from that exception. Ask the repairer or dealer to identify the arrangement in writing.[^1]

### Liability and damage to the loaner are different

When an operator’s policy provides coverage for damage to a qualifying loaned vehicle, Idaho’s statute makes that coverage primary but caps it at the lower of reasonable repair cost or the owner’s actual replacement cost; the owner’s policy is secondary or excess. This statutory order does not establish that a given policy includes physical-damage coverage.[^1]

## Who Regulates Insurance in Idaho

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 1.5% of premium when Idaho is the home state for property and casualty coverage Idaho’s surplus-lines tax is 1.5%. For property-and-casualty insurance other than workers’ compensation, if Idaho is the insured’s home state the full premium is taxed regardless of where covered risks are located; other lines follow the statutory allocation rule.
