# Florida Hired and Non-Owned Auto Coverage

Florida requires continuous security for vehicles registered in the state and extends that requirement to a nonresident vehicle after it has been physically present in Florida for more than 90 days in the preceding 365 days. Florida PIP is written around specified people and the insured vehicle: it includes the named insured, resident relatives unless excluded, people operating the insured motor vehicle, passengers, and certain pedestrians. The statute does not establish that an employer HNOA policy provides those benefits.[^1][^2]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. ## What to Watch for in Florida

### PIP turns on the insured and the vehicle

Florida’s statute names people covered under a policy and ties several categories to operation or occupancy of the insured motor vehicle. Ask whether the employee’s own policy, a rental vehicle’s policy, or the employer’s policy is the relevant insured policy for that trip; do not infer that HNOA supplies PIP.[^2]

### Initial medical care has a 14-day condition

For PIP medical benefits, Florida requires initial services and care within 14 days after the accident. Employees should know how to report an accident promptly and where to seek initial care, while the claim handler confirms policy and eligibility details.[^2]

### A long Florida stay can change the security question

The statute applies its security requirement to a nonresident’s vehicle after more than 90 days of physical presence in Florida during the prior 365 days, whether or not the vehicle was operated. Businesses with extended assignments should ask who owns or registers each vehicle and confirm the required security with the insurer.[^1]

### Surplus-Lines Tax and Stamping Office
