# Arkansas Hired and Non-Owned Auto Coverage

Arkansas requires both the motor vehicle and the person’s operation of it to be covered by qualifying insurance or self-insurance. When employees use their own cars or rentals for work, ask how the vehicle and operator requirements apply to that trip; the statute does not say that an employer’s HNOA policy automatically satisfies both.[^1][^2]

## What Is Hired And Non-Owned Auto?

Hired and non-owned auto (HNOA) liability protects the business when rented cars or employees’ own cars are used for work. It does not pay for damage to those vehicles, and it is not a substitute for commercial auto on vehicles the business owns. [Read the national Hired and non-owned auto guide](/coverage/hired-non-owned-auto).

## Arkansas Requirements

| Requirement | Details |
| --- | --- |
| Vehicle and operator coverage | Arkansas law makes it unlawful to operate a motor vehicle unless both the vehicle and the person’s operation are covered by qualifying insurance or self-insurance.[^1][^2] |

## What to Watch for in Arkansas

### Check both the vehicle and the driver’s operation

Arkansas’s statute names two things that must each be covered: the motor vehicle and the person’s operation. Do not assume a business HNOA endorsement, a rental agreement, or an employee’s policy satisfies the rule without checking the actual policy documents.[^1]

### Ask which policy is intended to cover the driver

The Arkansas act refers to both owner’s and operator’s motor vehicle liability policies in the financial-responsibility framework. If staff drive a vehicle they do not own, ask your broker to identify the applicable policy and its business-use terms.[^1]

### Confirm the insurer’s Arkansas eligibility

Act 345 of 2025 amended Arkansas’s financial-responsibility statutes to recognize insurance companies authorized or eligible to do business in the state. If a proposed policy is surplus-lines coverage, have the broker confirm the carrier’s eligibility and how the policy meets the applicable requirements.[^1][^2]

## Who Regulates Insurance in Arkansas

**Arkansas Insurance Department.** The Arkansas Insurance Department licenses resident and nonresident producers and business entities, accepts insurance complaints, and provides links to company and producer license searches. It operates as a division of the Arkansas Department of Commerce.[^3][^4][^8][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% when Arkansas is the insured's home state Arkansas's broker filing instructions set a 4% surplus-lines tax. Federal law assigns nonadmitted-insurance regulation and tax to the insured’s home state; for a multistate policy, ask your broker to show the home state and the premium allocation used for the Arkansas filing. Arkansas law requires the contract to disclose that the state's property-and-casualty guaranty protection does not apply.[^6][^7][^9]

## Providers With Documented State Licenses

These providers publish a national listing for Hired and non-owned auto; the state records document licenses for the entities and roles shown below. Some records rely on company-reported information rather than independent regulator verification. A national listing does not confirm that the product is available in Arkansas; [check the regulator’s license lookup](https://insurance.arkansas.gov/industry-regulation/licensing/) and confirm state availability for your business when requesting a quote.

- [Corgi](/insurance-providers/corgi) — **Entity:** Corgi Insurance Services, Inc.; **role:** Insurance producer; **checked:** 2026-09-28. **Scope:** Corgi’s company producer-license table lists 50 jurisdictions: 49 states and the District of Columbia, including DC license 3003091619. New Mexico does not appear in the table and is not included here; the omission does not establish that Corgi is unlicensed there. The company-reported table has no stated as-of date and does not establish product availability.[^12]

## Questions to Ask Before You Buy in Arkansas

1. Which policy is intended to cover the vehicle and which policy is intended to cover the employee’s operation when staff drive a personal or rented car for work?
2. How does the policy address business use, and what limits or exclusions apply to employees using their own vehicles?
3. If the proposed policy is placed with a surplus-lines insurer, is that company eligible to write the coverage for this Arkansas risk?

## Hired And Non-Owned Auto in Arkansas: FAQ

### Does Arkansas require coverage for both the vehicle and its driver?

Arkansas Code § 27-22-104(a)(1), as amended by Act 345 of 2025, says both the motor vehicle and the person’s operation must be covered by qualifying insurance or self-insurance.[^1]

### Does the two-part rule mean an HNOA policy automatically satisfies Arkansas insurance law?

No. The statute states the vehicle and operator requirements but does not determine whether a particular employer policy, employee policy, or rental agreement satisfies them. Ask the broker to identify the applicable policy for your actual use.[^1][^2]
