# Generative AI Liability Insurance in Vermont

Vermont law defines a visual image to include one created or altered by digitization using images of other people or computer-generated images. Knowingly disclosing an identifiable nude or sexual image without consent, with intent to harm or coerce and likely harm, can be criminal; a separate private action permits injunctions. A website or app may not charge the depicted person to remove the image.[^1][^2]

## What to Watch for in Vermont

### Vermont includes computer-generated intimate images

Under 13 V.S.A. § 2606, visual images include digital reproductions created or altered by digitization, which covers realistic alteration using images of people other than the depicted person or computer-generated images. Criminal liability requires knowing disclosure without consent, intent to harm, harass, intimidate, threaten, or coerce, and likely harm to a reasonable person. This is a defined intimate-image rule, not a general AI-output prohibition.[^1]

### Victims can sue and platforms cannot charge for removal

Section 2606 separately gives a plaintiff a private cause of action for knowing, nonconsensual disclosure of an identifiable nude or sexual image that causes harm, and permits restraining orders or injunctions. A website, online service, app, or mobile app containing the image may not solicit or accept a fee to remove or alter it when the depicted person requests removal. Keep intake and removal records and confirm whether policy wording includes equitable-relief response costs.[^1]

### Vermont separately prohibits certain nonconsensual recordings

Section 2605 addresses intentional viewing, photography, filming, or recording of intimate areas or sexual conduct without knowledge and consent where the person has a reasonable expectation of privacy, and prohibits disclosure of images recorded in violation of the section. If your system ingests private source photos before altering or generating content, distinguish alleged unlawful capture from downstream synthetic distribution in the claim chronology.[^2]

## Who Regulates Insurance in Vermont

**Vermont Department of Financial Regulation.** The Vermont Department of Financial Regulation administers Vermont insurance laws, oversees insurers and insurance producers within its authority, and provides regulatory and consumer resources.
