# Generative AI Liability Insurance in Utah

Utah requires a generative-AI supplier in a consumer transaction to disclose AI use when the individual clearly asks, while providers in regulated occupations must prominently disclose high-risk AI interactions at the start of verbal or written service. A separate 2026 provenance law will require covered providers to add latent disclosures to qualifying AI-generated or substantially modified audio, video, and images starting January 1, 2027.[^1][^2]

## What Is Generative AI Liability?

Generative AI liability can help pay covered defense costs and losses when someone claims your AI use caused harm, including infringement or data disclosure. If you use or sell AI outputs, check how the policy fits your role and existing liability coverage. [Read the national Generative AI liability guide](/coverage/generative-ai-liability).

## What to Watch for in Utah

### Utah’s consumer disclosure is triggered by a clear question

A supplier in a consumer transaction must say that an interaction is with generative AI rather than a human when the individual makes a clear, unambiguous request asking whether AI is being used. The law does not require the same disclosure in every ordinary consumer interaction; preserve prompt handling and response behavior for support channels.[^1]

### High-risk regulated services require disclosure at the start

An individual providing services in a regulated occupation must prominently disclose a high-risk AI interaction and comply with the occupation’s rules. Verbal disclosure is due at the start of a verbal interaction; written disclosure must come before the written interaction begins. Map professional services separately from general customer support.[^1]

### Utah’s provenance duties begin in 2027

Beginning January 1, 2027, a covered provider must include a latent disclosure in qualifying AI-created or substantially modified audio, video, or image content, to the extent technically feasible and reasonable. The disclosure must convey creation or alteration time and date and either manufacturer name or suitable digital signatures, and align with widely accepted standards. Plan controls and policy wording around that effective date.[^2]

## Who Regulates Insurance in Utah

**Utah Insurance Department.** The Utah Insurance Department regulates licensed insurance companies and producers, offers a public licensee search, and accepts complaints about property/casualty insurance. Complaint jurisdiction depends on policy type and place of issue; employer self-funded plans are outside the Department’s authority.[^3][^4][^5]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4.25% of gross premium including policy fees, plus 0.18% stamping fee For Utah-home-state surplus-lines coverage, Utah charges 4.25% of gross premiums including policy fees, less returned premiums, and the Surplus Line Association of Utah collects a 0.18% stamping fee. Utah law requires a policy notice that the nonadmitted insurer is not protected by any Utah guaranty association; the state’s current guidance says a good-faith admitted-market effort is generally required unless the coverage is on the export list.[^6][^7][^8][^9][^10]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://insurance.utah.gov/licensee-search/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Utah

1. Does a customer ask whether the service is using generative AI, and how does the product answer?
2. Does the workflow provide a regulated occupation’s high-risk service, and are disclosures made before or at the interaction’s start?
3. Will covered audio, image, or video outputs be delivered in Utah after the January 1, 2027 provenance requirements begin?

## Generative AI Liability in Utah: FAQ

### Must a Utah consumer supplier disclose AI use without being asked?

The cited consumer-transaction rule requires disclosure when an individual makes a clear and unambiguous request asking whether AI is being used.[^1]

### When do Utah’s latent provenance disclosures take effect?

The cited provisions take effect January 1, 2027, and apply to covered provider content that meets the statute’s criteria.[^2]
