# Generative AI Liability Insurance in Pennsylvania

Pennsylvania Act 125 of 2024 amended 18 Pa.C.S. § 3131 to include an artificially generated sexual depiction that realistically shows nudity or sexual conduct that did not occur in reality and was produced substantially through technical means. A person disseminating such a depiction with intent to harass, annoy, or alarm another may face the statutory offense; Title 42 separately provides a civil cause of action for unlawful dissemination.[^1][^2]

## What to Watch for in Pennsylvania

### The amended offense reaches synthetic depictions

Act 125 added definitions for artificial intelligence, generative AI, and artificially generated sexual depiction to § 3131. The depiction must appear authentically to show a person nude or engaging in sexual conduct that did not occur, and its production must substantially depend on technical means rather than physical impersonation. The offense also requires intent to harass, annoy, or alarm; the change does not establish a general cause of action for ordinary generated text or images.[^1]

### Pennsylvania has a separate civil route

Title 42 § 8316.1 authorizes a person to bring a civil cause of action based on unlawful dissemination of an intimate image under § 3131 and recover loss or injury. The criminal statute and civil provision are separate sources of exposure, so ask whether the quote treats statutory claims, defense costs, and any other privacy or publicity theories consistently.[^2]

### Intent and exceptions still shape the claim

The offense requires intent to harass, annoy, or alarm and has statutory exceptions for specified circumstances. For an AI tool provider, preserve whether the output was a user prompt, how the service handled it, who received the image, and what the accused distributor knew; these facts can distinguish creation from later dissemination and matter to a defense tender.[^1]

## Who Regulates Insurance in Pennsylvania

**Pennsylvania Insurance Department.** The Pennsylvania Insurance Department publishes state tools to check licensed producers, agencies, and insurers, and its Consumer Services Online portal accepts complaints about insurers, agents, brokers, and public adjusters.
