# Generative AI Liability Insurance in Oregon

Oregon’s 2025 amendments to ORS 163.472 include digitally created, manipulated, or altered depictions that are reasonably realistic within the unlawful intimate-image dissemination law. The offense retains consent, intent, and harm elements. Separately, ORS 260.665 requires a campaign communication containing synthetic media to disclose that the image, audio, or video was manipulated, subject to statutory conditions and exceptions.[^1][^2]

## What Is Generative AI Liability?

Generative AI liability can help pay covered defense costs and losses when someone claims your AI use caused harm, including infringement or data disclosure. If you use or sell AI outputs, check how the policy fits your role and existing liability coverage. [Read the national Generative AI liability guide](/coverage/generative-ai-liability).

## What to Watch for in Oregon

### Oregon’s new intimate-image language focuses on realistic depictions

The 2025 amendment includes a digitally created, manipulated, or altered depiction that is reasonably realistic. Review the exact definition and other elements in ORS 163.472; synthetic status alone does not establish the offense.[^1]

### The disclosure offense still has intent and harm conditions

Oregon’s intimate-image law requires the statute’s specified lack of consent, mental state, and harm elements. Distinguish those facts from a general failure to label generated media, which is addressed separately in campaign communications.[^1]

### Campaign synthetic media must carry the statutory disclosure

ORS 260.665 defines synthetic media as intentionally manipulated realistic but false media that produces the specified effect, and requires a disclosure in campaign communications containing it. Preserve versions of the ad and the disclosure shown with each distribution.[^2]

## Who Regulates Insurance in Oregon

**Oregon Division of Financial Regulation.** DFR handles complaints about most insurance lines and provides Oregon license checks for agents, agencies, and insurers. You can use its consumer complaint form if an insurer or agent is not following Oregon law or rules.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 2% of Oregon-home-state gross premiums, plus 0.3% on premium or fees for fire marshal For Oregon-home-state risks, the surplus-lines licensee must collect a 2% tax on gross premiums and a 0.3% fire-marshal tax on premium or fees, in addition to the premium. Oregon requires the policy to warn that losses will not be paid by the state guaranty fund; the exempt-commercial-purchaser search exception requires admitted-market disclosure and a written request.[^7][^8][^9][^10]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://dfr.oregon.gov/help/complaints-licenses/Pages/check-license.aspx) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Oregon

1. Does moderation screen for realistic computer-generated intimate depictions under the amended ORS 163.472?
2. Can political-ad review capture the exact media and disclosure accompanying every Oregon campaign communication?
3. Does the quote distinguish intent-based intimate-image claims from election-ad disclosure claims?

## Generative AI Liability in Oregon: FAQ

### Does Oregon require labels on every AI-generated image?

The cited disclosure rule applies to campaign communications containing statutory synthetic media. It is not a universal labeling rule for every AI-generated output.[^2]

### Can a victim pursue civil relief for intimate-image dissemination?

Oregon law separately authorizes a civil action for dissemination of an intimate image, including available damages and attorney fees, in addition to other remedies. Confirm that the fact pattern meets that section’s elements.[^3]
