# Generative AI Liability Insurance in Oklahoma

Oklahoma’s amended nonconsensual-image offense expressly includes an artificially generated sexual depiction that appears to show nudity or sexual conduct that did not occur. For those synthetic depictions, the statute requires intent or reckless disregard to harass, threaten, alarm, or cause specified harm, plus lack of effective consent; the Oklahoma Consumer Protection Act separately prohibits specified false or misleading representations in consumer transactions.[^1][^3]

## What Is Generative AI Liability?

Generative AI liability can help pay covered defense costs and losses when someone claims your AI use caused harm, including infringement or data disclosure. If you use or sell AI outputs, check how the policy fits your role and existing liability coverage. [Read the national Generative AI liability guide](/coverage/generative-ai-liability).

## What to Watch for in Oklahoma

### Oklahoma requires harmful intent or reckless disregard

For an artificially generated sexual depiction, Oklahoma requires dissemination without effective consent and intent or reckless disregard to harass, annoy, threaten, alarm, or cause physical, emotional, reputational, or economic harm. This is a narrower trigger than mere generation; review who can publish outputs and what consent evidence is retained.[^1]

### Removal orders and repeat conduct matter

A court may order the defendant to remove a disseminated image or synthetic depiction when removal is within that defendant’s power. Disseminating three or more images or depictions within six months is a Class D1 felony under the statute, so incident response should preserve a count and timeline across posts.[^1]

### Oklahoma separately defines generated sexual depictions

The 2026 enrolled amendment defines an artificially generated sexual depiction as an authentic-looking image of an individual in nudity or sexual conduct that did not happen in reality, produced substantially through technical means. The same bill addresses child sexual abuse material; do not assume adult-image consent controls satisfy child-content restrictions.[^2]

### Oklahoma also polices misleading consumer representations

The Consumer Protection Act treats specified false or misleading statements about a consumer transaction’s source, sponsorship, approval, or certification as unlawful. If product marketing makes claims about an AI system’s authorship, authenticity, or approval, retain substantiation and review the wording against the actual product behavior.[^3]

## Who Regulates Insurance in Oklahoma

**Oklahoma Insurance Department.** OID's Licensing Division oversees new and renewed producer, adjuster, and business-entity licenses. Its consumer assistance process takes insurance complaints and requests for help; the licensee lookup displays license status and expiration.[^4][^5][^6]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 6% of premium and fees, plus 0.175% SLAS transaction fee For Oklahoma-home-state placements, OID says the 6% surplus-lines tax base includes premium and fees; SLIP also bills a 0.175% SLAS transaction fee. Oklahoma law requires a policy notice that surplus-lines coverage has no guaranty-association protection, so ask your broker to itemize the tax and transaction fee.[^7][^8][^9]

## Providers With Documented State Licenses

No provider in Spot’s research documents both a state license record and this coverage line. This does not establish that providers are unlicensed. [Check the regulator’s license lookup](https://www.oid.ok.gov/licensing-and-education/licensee-look-up/) and confirm availability with a provider when requesting a quote.

## Questions to Ask Before You Buy in Oklahoma

1. Who can distribute generated sexual images, and how is effective consent checked and recorded?
2. Can response staff identify repeated depictions in a six-month window and remove content within the operator’s control?
3. How do policy terms treat criminal defense, takedown activity, and allegations involving child sexual abuse material?

## Generative AI Liability in Oklahoma: FAQ

### Is creating a depiction alone the Oklahoma offense described here?

The cited offense centers on dissemination without effective consent together with the specified intent or reckless disregard.[^1]

### When can repeat synthetic-image dissemination become a felony?

Three or more images or artificially generated sexual depictions disseminated within six months can trigger a Class D1 felony under the statute.[^1]
