# Generative AI Liability Insurance in Ohio

Ohio Revised Code § 2917.211 prohibits knowing dissemination of a fabricated sexual image without consent and separately prohibits creating or soliciting its creation with intent to distribute when done to harass, extort, threaten, or cause specified harm. The conduct is a felony, with higher grades for qualifying repeat offenders. Section 2307.66 gives victims a civil action for injunctions, compensatory and punitive damages, fees, and costs, and presumes harm.[^1][^2]

## What to Watch for in Ohio

### Creating an image and disseminating it are separate statutory acts

Section 2917.211(C) covers knowing nonconsensual dissemination of a fabricated sexual image; subsection (D) separately covers creation or solicitation without consent and with intent to distribute when done for a listed harmful purpose. A model’s user, operator, and publisher may have different roles under these provisions.[^1]

### Prior convictions can raise felony severity

The statute generally classifies fabricated-image dissemination and creation as fourth-degree felonies, with specified prior convictions raising each to a third-degree felony. Preserve prior-incident information and assess whether multiple actors or repeated outputs are alleged.[^1]

### Victims receive a statutory presumption of harm

Section 2307.66 allows an injunction or temporary restraining order, compensatory and punitive damages, attorney fees, and costs; it presumes harm and gives four years after discovery to sue. Ask how the policy treats injunctive orders and claim-report timing.[^2]

## Who Regulates Insurance in Ohio

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 5% of gross premium, net of return premiums For Ohio-home-state surplus-lines placements, Ohio sets a 5% tax on gross premiums after returned premiums and requires the surplus-lines broker to collect it when the policy is delivered. A diligent search usually applies; a qualifying exempt commercial purchaser may request nonadmitted placement in writing after disclosure that authorized-market coverage may offer greater protection, and the policy requires a signed notice of no Ohio guaranty-association benefits.[^6][^7][^8]
