South Dakota bars specified construction-deficiency injury, property-damage, contribution, or indemnity actions against covered design and construction participants more than ten years after substantial completion. SDCL §15-2A-3 covers actions for injury to real or personal property and personal injury or death arising from a deficiency in design, planning, supervision, inspection, or construction, plus related contribution or indemnity actions. Its ten-year period starts at substantial completion, defined by when the owner can occupy or use the improvement as intended; ask how long completed-operations protection should remain in place.[^1]

### Architect and Engineer Errors Are Narrowly Carved Out

South Dakota requires construction contract indemnity language to exclude an architect’s or engineer’s liability for specified design documents and directions when that act or omission is the primary cause of injury or damage. Review project contracts for this required scope limit and ask how any separate insured-contract or additional-insured terms interact with it.[^2]

### Claimant Fault Can Reduce a Negligence Award

SDCL §20-9-2 reduces negligence damages in proportion to plaintiff fault but bars recovery when that negligence is more than slight compared with the defendant’s negligence. For a shared-fault defense, ask the broker how the policy’s limits and defense obligations apply to the insured’s potential allocated share.[^3]
