# General Liability Insurance in North Dakota

North Dakota bars a claimant whose contributing fault is as great as the combined fault of everyone else who contributed to the injury. Section 32-03.2-02 bars recovery when a claimant’s fault is as great as the combined fault of all other people who contributed to the injury, then reduces any recovery by the claimant’s share. Preserve evidence identifying each actor’s conduct; the comparison includes nonparties who contributed, not only named defendants.[^1]

### Multi-Party Liability Usually Follows Each Party’s Share

When two or more parties contributed to an injury, each is generally liable only for damages assigned to that party’s percentage of fault. Parties who act in concert, aid or encourage the tort, or ratify or adopt it for their benefit are jointly liable for damages assigned to their combined fault; ask how the business’s limit would apply if a complaint alleges coordinated conduct.[^1]

### The Six-Year Period Covers Listed Noncontract Claims

North Dakota § 28-01-16 gives six years after accrual for listed claims, including injury to a person or rights not otherwise provided for and taking, detaining, or injuring chattels. The period is not a universal deadline for every claim; have counsel identify the claim category and accrual date, and keep policy notice deadlines separate.[^2]

### A Construction Clause Cannot Shift Certain Plan Errors

Section 9-08-02.1 voids a construction-contract provision that makes a contractor liable for errors or omissions of the owner or the owner’s agents in the plans and specifications. The statute does not state what a liability policy covers; ask the broker to review the actual policy and contract language separately.[^3]
