# General Liability Insurance in New Mexico

New Mexico’s Several Liability Act generally makes defendants severally liable in claims governed by comparative fault. It preserves joint liability for vicarious relationships, but only for the portion attributed to the employee or agent; New Mexico appellate decisions explain how an employee release can therefore affect the employer’s claim exposure.[^1][^2]

### Several Liability Is the General Rule

NMSA 1978, §41-3A-1(A) abolishes joint-and-several liability in causes governed by comparative fault, assigning each defendant its share. Ask whether the pleaded cause is one to which comparative fault applies before using that rule to estimate your company’s exposure.[^1]

### An Employer Can Carry the Employee’s Attributed Share

Section 41-3A-1(C)(2) preserves joint liability between persons in a vicarious relationship, limited to the portion assigned to those persons. In Valdez v. R-Way, the Court of Appeals held that a release of the employee extinguished a derivative employer claim where the employer had no independent fault; coordinate settlement and release language with counsel before resolving an employee claim.[^1]

### Seat-Belt Nonuse Is Excluded From Comparative-Fault Analysis

In Williams v. Rodriguez, the New Mexico Court of Appeals held that the seat-belt statute bars consideration of nonuse in comparative fault. For a claim involving a motor-vehicle injury on a business trip, ask counsel which other conduct can be considered; this narrow statutory protection does not resolve the policy’s coverage.[^2]

**New Mexico Office of Superintendent of Insurance.** New Mexico OSI licenses insurance producers and agencies, oversees insurers and reviews insurance forms and rates. ### Surplus-Lines Tax and Stamping Office

### Is New Mexico a joint-and-several-liability state?

Generally no for claims governed by comparative fault: defendants are severally liable for their shares under §41-3A-1(A). The statute preserves limited joint liability, including for vicarious relationships.[^1]

### Can releasing a New Mexico employee also release the employer?

It can when the employer’s liability is solely vicarious and the employee is released; the Court of Appeals held that the derivative claim was extinguished in Valdez v. R-Way. The result does not decide a separate claim based on the employer’s own negligence.[^1]
