# General Liability Insurance in Nevada

Nevada permits recovery when claimant fault is not greater than the defendant’s or defendants’ combined fault; damages are reduced by the claimant’s share. ### A Fault Tie Does Not Bar Recovery

NRS 41.141 allows recovery when the claimant’s negligence is not greater than the defendants’ combined negligence, but reduces damages by the claimant’s share. Ask what evidence is needed to identify all potentially responsible parties before a claim is resolved.[^1]

### Ordinary Negligence Usually Stays Several

For multiple defendants, NRS 41.141 generally makes each defendant liable only for its allocated share. The statute preserves joint-and-several liability, if otherwise applicable, for strict liability, intentional torts, toxic or hazardous releases, concerted acts, and product claims; ask whether any pleaded theory falls within an exception.[^1]

### Personal Injury and Property Damage Use Different Periods

NRS 11.190 lists a two-year period for injury to a person or wrongful death and a three-year period for taking, detaining, or injuring personal property. Exceptions and accrual rules apply, so separate bodily-injury and property-loss allegations before setting a litigation timeline.[^2]

### Surplus-Lines Tax and Stamping Office
