# General Liability Insurance in Nebraska

Nebraska bars a negligence claimant only when the claimant’s fault is equal to or greater than the total fault of the persons against whom recovery is sought. In multi-defendant actions, economic damages can remain joint and several while noneconomic damages are generally several-only, and § 25-207 sets four years for listed tort and property claims.[^1][^2][^3]

## What to Watch for in Nebraska

### Fault at Half or More Bars Recovery

Nebraska reduces damages in proportion to a claimant’s fault, but bars recovery when that fault equals or exceeds the total fault of all persons from whom recovery is sought. Ask the insurer to document how the claim team will treat fault allocation when several parties are named.[^1]

### Economic and Noneconomic Damages Follow Different Allocation Rules

When an action has multiple defendants, Nebraska generally makes each defendant jointly and severally liable for economic damages but limits noneconomic damages to each defendant’s percentage of fault. The rule differs for defendants acting in a common enterprise or plan, so identify other responsible parties and their roles when you report the claim.[^2]
