# General Liability Insurance in Louisiana

For causes of action arising on or after January 1, 2026, a claimant who is at least 51% at fault ordinarily cannot recover under Civil Code art. 2323; subsection C says recovery is not reduced when an intentional tortfeasor also contributed. Delictual actions generally have a two-year prescription from when injury or damage is sustained for the period effective July 1, 2024, so the event date and claim type matter.[^1][^2][^4]

### A 51% Fault Bar Applies to New Causes of Action

Act 15 of 2025 changed the comparative-fault threshold for causes arising on or after January 1, 2026: 51% claimant fault ordinarily bars recovery. Article 2323(C) preserves unreduced recovery when fault of an intentional tortfeasor also contributed, so give the adjuster the incident date and the conduct of each party.[^1][^2]

### The General Delictual Period Is Now Two Years

For delictual actions, art. 3493.1 sets a two-year prescription period starting when injury or damage is sustained; the change applies from July 1, 2024. Ask the broker how the policy handles reporting and defense if a demand comes well after the occurrence.[^4]

### Co-Defendants Usually Owe Their Own Fault Share

For non-intentional conduct, art. 2324 makes liability joint and divisible, and a tortfeasor is not solidarily liable for damages attributable to another person’s fault. If a subcontractor or other defendant cannot pay, ask whether the insured’s own limit is sized for its potential allocation; the statute has an intentional-conspiracy exception.[^3]

### Surplus-Lines Tax and Stamping Office
