# General Liability Insurance in District of Columbia

A claimant seeking unliquidated personal or property damages from the District generally must give the Mayor written notice within six months, describing the approximate time, place, cause, and circumstances. D.C. also imposes a ten-year outside limit on specified injury claims arising from defective or unsafe improvements, subject to statutory exceptions.[^2][^3]

## What to Watch for in District of Columbia

### District Claims Need Early Written Notice

D.C. Code §12-309 generally requires written notice within six months for unliquidated personal or property damage claims against the District; it must identify approximate time, place, cause, and circumstances. A regular-course MPD report is sufficient, and two statutory claim categories are excepted. If a city agency or District location is involved, ask counsel to calendar notice immediately.[^2]

### Construction Claims Have a Separate Outside Limit

Section 12-310 applies a ten-year period to specified personal injury, property damage, wrongful-death, contribution, and indemnity actions arising from defective or unsafe real-property improvements. It excludes contract actions, claims against owners/actual possessors or controllers, manufacturers/suppliers, and the District government; ask whether the claim fits this narrow category.[^3]

### Property Claim Period Depends on the Claim

Section 12-301 generally lists three years for real or personal property damage and for actions without another special period, but one year for specified intentional torts. Ask counsel to classify the asserted claim rather than assuming one D.C. deadline covers every GL loss.[^1]

### Identify the Defendant Before Setting Dates

The six-month notice rule applies to claims against the District of Columbia, not automatically to every private business operating in D.C. Ask whether the named defendant is the District and whether an exception applies before relying on §12-309.[^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** Generally 2% of gross premium, including qualifying placement fees When the District is the insured’s home state, surplus-lines agents and brokers generally owe a 2% tax on gross premium, including necessary fees incidental to placement when separately itemized. An agent or broker procuring insurance on behalf of the District government is exempt for that government business; claiming the exemption requires identifying its allocation in the required affidavit and does not waive other statutory duties. Ask the broker which taxes and fees your agreement passes through to you. DISB generally requires a diligent effort to place risks with authorized insurers. For a purchaser meeting the federal exempt-commercial-purchaser definition, the broker may skip that search only after disclosing that insurance may or may not be available from the admitted market, which may provide greater protection with more regulatory oversight, followed by the purchaser’s written request for nonadmitted placement.
