# General Liability Insurance in Colorado

Colorado reduces damages for a claimant’s fault only when that fault is less than the defendant’s; an equal share bars recovery under §13-21-111. In ordinary tort cases each defendant generally pays only its own share, but a two-year deadline does not apply to motor-vehicle torts, which have a separate limitations rule.[^1][^2]

## What to Watch for in Colorado

### An Equal Fault Share Bars Recovery

Under C.R.S. §13-21-111, claimant fault must be less than the defendant’s fault for recovery; otherwise the claim is barred, and any allowed award is reduced proportionally. Ask whether the claim’s evidence supports an allocation below or above that threshold.[^1]

### Most Defendants Pay Their Own Share

C.R.S. §13-21-111.5 generally caps each defendant’s liability at its own fault percentage, with joint liability for people who consciously conspire and deliberately pursue a common plan to commit a tort. Ask how your limit is sized for the insured’s own share and any conduct attributed through agency.[^1]

### An Admission Does Not End Direct-Negligence Claims

Section 13-21-111.5(1.5) says an employer or principal does not avoid its own direct-negligence claims or related discovery by admitting an employee’s or agent’s course-and-scope. If your business uses staff or agents, ask whether the quote covers the operations and entities named in the proposed policy.[^1][^3]

### Check Whether the Claim Involves a Vehicle

C.R.S. §13-80-102(1)(a) sets two years for ordinary tort claims, including negligence. Tort bodily-injury or property-damage actions arising from motor-vehicle use are separately treated under §13-80-101(1)(n), so ask which rule fits before using the general two-year date.[^1][^2]

## Who Regulates Insurance in Colorado

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of net premium When Colorado is the insured’s home state, its surplus-lines tax is 3% of taxable premium. The Colorado Surplus Lines Association says insurer or broker fees charged in connection with the placement are included in the tax base; federal or other-state taxes and examination fees are excluded. For multistate risks, a tax-sharing agreement may allocate premium tax to other states.[^7][^9][^8]
