# Fiduciary Liability Insurance in Connecticut

Connecticut § 38a-512a applies only to group health policies providing a coverage type listed in § 38a-469(1), (2), (3), (4), (11) or (12). For covered policies, specified layoff, reduced-hours, leave or termination events generally allow up to 30 months, but other group coverage and event-specific exceptions can shorten or change that period; Connecticut Insurance Department guidance says the expanded period reaches fully insured employer plans of any size.[^1][^2][^3]

### Confirm The Plan And Policy Scope

Section 38a-512a applies to group health policies in Connecticut that provide a coverage type listed in § 38a-469(1), (2), (3), (4), (11) or (12). Separately, the Insurance Department says the 30-month expansion reaches fully insured employer plans of any size. Identify the policy, funding and listed coverage category before applying the state deadline.[^1][^2]

### Match The Event To The Right Period

Section 38a-512a(a)(1)(A) generally provides up to 30 months after layoff, reduced hours, leave or termination, except death or gross misconduct, and ordinarily ends earlier when other group insurance becomes available. If reduced hours, leave or termination results from the employee's eligibility to receive Social Security income, continuation ends at midnight before Medicare eligibility; that special endpoint does not list layoff. Death and other events have separate periods. Existing collectively bargained group policies are not altered or impaired; the section applies at the next regular renewal and after the collective-bargaining agreement is complete.[^1]

The ordinary Connecticut continuation option ends when the person becomes eligible for other group insurance. The statute has exceptions for illness or injury (up to 12 months) and for total disability when a group policy ends (up to 12 calendar months, with a timely claim); map those dates separately.[^1]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 4% of gross premium when Connecticut is the home state When Connecticut is the insured’s home state, surplus-lines tax is 4% of gross premium; certain state and local government insureds are exempt, and broker or policy fees are not part of the premium-tax base.
