# Fiduciary Liability Insurance in Colorado

For a carrier-issued Colorado employer group health plan that remains in force for active employees, an employee may elect continuation after termination if required contributions were paid through that date and coverage was continuous for at least six months; discontinuance of the whole policy or insured class and Medicare or Medicaid coverage are exclusions. Eligible continuation generally lasts up to 18 months, subject to the other-group-coverage rule.[^1][^2][^3]

## What to Watch for in Colorado

### Check The Six-Month Coverage Record

Colorado continuation is available only when the employer group plan remains in force for active employees, the termination is not due to discontinuance of the entire group policy or an insured class, required premiums or contributions are paid through termination, and the employee had six months of continuous coverage immediately before termination (including similar coverage under a replaced group plan). The employer need not offer it to someone covered by Medicare or Medicaid. Have HR verify each condition before treating the person as eligible.[^1][^3]

### Track The Colorado Notice Deadline

Under § 10-16-108(1)(e)(II), a written communication signed by the employee or an employer notice mailed to the last-known address and postmarked within ten days after termination satisfies the notice rule. The employee generally must elect and pay within 30 days; if the employer fails to notify an eligible employee of the right to elect, the employee can retain coverage by making proper payment within 60 days after termination. Assign owners for both dates.[^1]

### Map When New Group Coverage Starts

Colorado continuation generally ends when the employee or dependent becomes eligible for other group coverage. If that coverage excludes a condition covered by the prior plan, § 10-16-108(1)(e)(I) permits prior-plan continuation for that condition until the new plan covers it or the 18-month period ends; track the new-plan eligibility and exclusion records.[^1]

## Who Regulates Insurance in Colorado

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of net premium When Colorado is the insured’s home state, its surplus-lines tax is 3% of taxable premium. The Colorado Surplus Lines Association says insurer or broker fees charged in connection with the placement are included in the tax base; federal or other-state taxes and examination fees are excluded. For multistate risks, a tax-sharing agreement may allocate premium tax to other states.[^7][^9][^8]
