# Fidelity Coverage for Kansas State Credit Unions

Kansas law assigns the board of a state credit union responsibility to authorize adequate fidelity and insurance coverage for officers, directors, committee members and employees, plus losses caused by outside persons for which the credit union may be liable. The statute does not set a fixed fidelity amount, so the board needs an institution-specific rationale rather than borrowing another state’s schedule.[^1][^2]

## What to Watch for in Kansas

### Keep the board’s adequacy decision tied to actual exposures

Kansas uses an adequacy standard rather than a fixed limit in §17-2209(b)(4). Document officers and staff with access to money or securities, payment controls, transaction volume and plausible loss size so the board can explain its chosen amount at renewal.[^1]

### Do not collapse outside losses into employee fidelity

The statute separately names coverage for losses caused by persons outside the credit union for which it may be liable. Ask whether the quote addresses those external actors and how that protection differs from employee or official dishonesty.[^1]

### Do not apply the board duty to ordinary businesses

The provision is in the Kansas Credit Union Code and assigns the obligation to a credit union board. It does not impose a general fidelity insurance mandate on Kansas employers or determine what a policy covers.[^1][^2]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premiums less returned premiums for surplus-lines insureds whose home state is Kansas; the 3% rate applies beginning with taxable year January 1, 2024 For surplus-lines business whose insured's home state is Kansas, the licensed agent must collect and pay a 3% tax on gross premiums less returned premiums; the 3% rate applies beginning with the taxable year starting January 1, 2024. For an exempt commercial purchaser, the surplus-lines producer need not file the signed diligent-search statement after disclosing that admitted-market insurance may or may not be available and may provide greater protection and oversight, then receiving the purchaser's subsequent written request.[^6][^7]
