# Fidelity Bonds for Hawaii Condominium Associations

For a Hawaii condominium association with more than five dwelling units, unless the declaration or bylaws provide otherwise, the statute requires a fidelity bond covering people who control or disburse association funds: $500 per unit, with a $20,000 minimum and $200,000 maximum. The managing company has its own bond duty under a separate formula in §514B-132(a)(3), so associations and managers should compare both obligations before relying on one certificate.[^1][^2][^3]

## What Is Fidelity Bonds?

Fidelity coverage can reimburse certain losses when employees steal money or property they handle. If employees manage company funds, customer property or benefit-plan assets, identify each owner and compare the required protection for each interest. ## What to Watch for in Hawaii

### Use the right unit count and floor

The association-level formula applies only when the project has more than five dwelling units and is capped at $200,000, but it cannot drop below $20,000. A small project therefore may owe the minimum even when $500 per unit is lower; document the covered dwelling-unit count before choosing the limit.[^1]

### Do not combine the association and manager duties by assumption

Section 514B-143 addresses the association’s own bond, while §514B-132(a)(3) separately requires a managing agent’s bond based on the aggregate units managed. Ask whose policy is being shown, which associations and funds it covers, and whether the association is a covered party for a loss claim.[^1][^2]

### Name every person who controls or disburses funds

The association bond must cover persons who control or disburse association funds, including the managing agent and its employees. Compare that class with the bank signers, accounting staff and management-company employees who can initiate or approve transfers; a statutory formula alone does not prove those people fit a policy’s wording.[^1]

### Check governing documents and nonresidential use

Section 514B-143 begins with an exception where the declaration or bylaws provide otherwise and permits the section to be varied or waived when every unit is restricted to nonresidential use. Check both the project’s governing documents and unit-use restrictions before treating the association-level formula as controlling; §514B-132’s managing-agent duty is separately stated.[^1][^2]

## Who Regulates Insurance in Hawaii

### Does the association formula apply to every Hawaii condominium?

The formula in §514B-143(a)(3)(A) applies to associations with more than five dwelling units. The statute separately requires bonds for management companies responsible for association funds under §514B-132(a)(3).[^1][^2]

### Is a fidelity bond the same as directors-and-officers liability?

No. Hawaii lists the association’s fidelity bond and D&O coverage as separate requirements in §514B-143. The bond addresses dishonest loss by covered fund handlers; D&O coverage addresses a different liability exposure.[^1]
