# Arizona Fidelity Bonds for Credit Unions

Arizona-chartered credit unions must maintain fidelity coverage in the form and amount required for federal share insurance, and the state rule expressly adds faithful-performance-of-duty coverage. ## What Is Fidelity Bonds?

Fidelity coverage can reimburse certain losses when employees steal money or property they handle. If employees manage company funds, customer property or benefit-plan assets, identify each owner and compare the required protection for each interest. ## What to Watch for in Arizona

### Check the Arizona faithful-performance term

Arizona requires any bond purchased to comply with R20-4-401 to include faithful-performance-of-duty coverage. Ask the carrier to point to the operative clause in the credit union form; a general employee-dishonesty label does not prove that this added term is present.[^1]

### Reconcile state and federal requirements

The Arizona rule ties form and amount to maintaining federal account insurance; NCUA’s current bond resource describes the federal requirement, asset-based minimums, covered personnel, and periodically updated approved forms. Confirm the credit union’s charter and share-insurance status before using a form or limit.[^1][^2]

### Check the issuer and the credit union’s own assets

The Arizona rule requires the bond to come from an insurer holding a certificate of authority to transact surety business in the state. Separately verify the named credit union, employee/director population, money and securities exposures, and treatment of outside fraud or computer-transfer loss.[^1][^2]

### Keep plan assets separate from credit-union assets

If the credit union or an employer client also handles private ERISA plan assets, review the plan’s bond separately. ERISA protects the plan against specified fraud or dishonesty; it is not automatically met by a credit-union bond for the institution’s own assets.[^3]

### Surplus-Lines Tax and Stamping Office

**Reported tax rate:** 3% of gross premium and taxable policy fees, less returns; stamping fee rate not verified When Arizona is the insured’s home state, the tax is 3% of gross premium and taxable policy fees, less returned premium; the statute excludes stamping fees from that tax base. For a multistate risk, Arizona’s share is allocated by exposure under the statute. Arizona's surplus-lines policy notice says these policies do not receive guaranty-fund protection. **Arizona has an exempt-commercial-purchaser search exception:** A surplus-lines broker generally must make diligent effort to place an Arizona risk in the admitted market.
